      Rambus Says Court Stays Hynix Trial

      Rambus Says Court Stays Hearing in Hynix Lawsuit Pending a Federal Trade Commission Ruling

      LOS ALTOS, Calif. (AP) -- Rambus Inc., which licenses computer memory chip technology, said late Tuesday a court has conditionally stayed the final stage of its patent-infringement battle with Hynix, a maker of memory chips.

      The case was originally filed by Hynix against Rambus in 2000, seeking declaratory judgments that Rambus patents are invalid and not infringed. All 10 patents in question, however, were found to be valid and infringed.

      In late July, Rambus said it would accept $133.6 million in damages from Hynix Semiconductor Inc., less than half of the $306.9 million a jury had ordered Hynix to pay for the 10 patent infringements, after a judge in the U.S. District Court determined the lower amount due to the number of Hynix products in the U.S. between 2000 and 2005.

      Rambus is also suing Hynix for alleged patent infringements on products shipped this year.

      The next hearing was scheduled for Aug. 21, but, the U.S. District Court for the Northern District of California conditionally stayed the final stage of the trial until Feb., 2 or the issuance of a final order from the Federal Trade Commission.

      The FTC ruled earlier in August that Rambus deceived a standards-setting committee. Rambus has said it plans to appeal.

      The FTC case was centered on weather Rambus illegally obtained a monopoly in the 1990s when it secured patents for two types of memory used in personal computers. Rambus was accused of failing to disclose to an engineering council that its patents had been incorporated into an industry standard regarding memory technology. Rambus has argued it did disclose the patents.

      The company and the FTC, the federal agency that investigates allegations of unfair competition or business practices, must file briefs on the newest ruling by Sept. 15. Replies are due Sept. 29.

      The Court said one reason for the stay was the potential for a resolution of the case once the FTC sets royalty rates on memory technology used by Rambus.

      "The Court has expressed its view that the Commission's decision has increased the potential for a resolution of this case and the several other litigation between Rambus and various DRAM manufacturers," said Robert Kramer, acting general counsel at Rambus, in a statement.

      The stay also gives Hynix ninety days to try to establish the applicability of any findings of the FTC to this phase of the Hynix case.

      Rambus Loses Ruling, Delaying Hynix Patent Infringement Case

      Aug. 23 (Bloomberg) -- Rambus Inc. lost a ruling in its patent dispute with Hynix Semiconductor Inc., delaying the final phase of the case until the U.S. Federal Trade Commission issues its penalty in an antitrust lawsuit against Rambus.

      U.S. District Judge Ronald Whyte in San Jose, California, said yesterday that the third trial in the Hynix case, originally set to begin next month, will take place no sooner than February. The FTC ruled Aug. 2 that Rambus engaged in ``deceptive conduct'' in order to control patents for high-speed computer memory chips.

      Rambus, a computer-chip designer based in Los Altos, California, has sued memory makers including Hynix, Samsung Electronics Co. and Nanya Technology Corp. for infringing its patents. In the final phase of the patent case, Hynix says it will use the same arguments presented by the FTC: that Rambus attended meetings of a memory-chip standards panel without disclosing the patents it would later enforce.

      Whyte's ruling ``goes a long way towards supporting our claim that Rambus is not entitled to enforce these patents based on the antitrust laws,'' Ken Nissly, a lawyer representing Hynix, said in an interview late yesterday. The rulings issued by Whyte and the FTC ``present significant obstacles'' to Rambus enforcing its patents against the entire chip industry, Nissly said.

      A federal jury in April awarded Rambus $307 million in its dispute with Ichon, South Korea-based Hynix, the world's second- largest memory chipmaker. Jurors agreed with Rambus's claim that Hynix infringed patents covering fundamental aspects of dynamic random access memory, or DRAM, the main type of memory used in computers. Whyte later reduced the award to $133.4 million.

      `Encourage Settlement'

      Robert Kramer, Rambus's acting general counsel, said in an e-mailed statement that Whyte delayed the final trial to encourage a settlement. It will be ``Hynix's burden to establish'' which of the FTC's findings it can use to defend against Rambus's infringement claims, he said.

      In the FTC case, the commission found that Rambus monopolized four aspects of an industry standard for memory chips. The ruling threatens to reduce Rambus's ability to collect royalties that provide 80 percent of its revenue. Rambus has said it will appeal the decision. The FTC hasn't said when it will announce the penalty.

      Rambus and the FTC staff must submit arguments by Sept. 15 on whether the company should be barred from getting royalties on memory chips that comply with the standard.

      Rambus has also filed antitrust lawsuits in state court against Hynix, South Korea's Samsung and Micron Technology Inc. claiming the companies conspired to fix prices and keep Rambus out of the memory chip market.

      Price-Fixing

      Hynix, Samsung, Germany's Infineon and Japan's Elpida Memory Inc. have pleaded guilty to U.S. criminal charges for price- fixing. Boise, Idaho-based Micron, the biggest DRAM maker in the U.S., wasn't charged after it cooperated with prosecutors.

      ``If parts of the FTC's decision are taken as fact, it will hurt Rambus's odds on prevailing'' in its patent case against Hynix, said Michael Cohen, a director of research at San Diego- based Pacific American Securities. Cohen said he owns 500 Rambus shares and has a ``buy'' rating on the stock.

      Rambus investors are afraid Whyte's decision might cause the company to ``cut a cheap deal'' with Hynix or any of the memory manufacturers it has sued, ``as opposed to pushing forward with its antitrust case in California,'' Cohen said.

      The FTC penalty ``should not affect Hynix's past-due damages for its infringement of Rambus's patents,'' Rambus's Kramer said in an e-mailed statement. Whyte acknowledged in his order that the FTC penalty will not resolve the companies' dispute over double data rate 2, or DDR2, chips, Kramer said.

      Given the DDR2 exemption and the antitrust case pending in state court in San Francisco, ``Rambus has strong reasons to believe it will be fairly compensated for its inventions,'' Kramer said.

      Rambus's Final Trial in Hynix Patent Case Is Delayed (Update3)

      Aug. 22 (Bloomberg) -- A federal judge delayed the final phase of Rambus Inc.'s six-year patent dispute with Hynix Semiconductor Inc. until the U.S. Federal Trade Commission determines the penalty in an antitrust case against Rambus.

      U.S. District Judge Ronald Whyte in San Jose, California, ruled today that the third trial involving the companies, previously set to start next month, will take place no earlier than February. The FTC found on Aug. 2 that Rambus engaged in ``deceptive conduct'' in order to control patents for high-speed computer memory chips.

      ``The FTC's findings that Rambus violated antitrust laws are going to be part of our antitrust case, which is based on the same conduct,'' Ken Nissly, a lawyer for Hynix, said in an interview.

      A settlement between Rambus, a designer of memory chips, and companies it sued for patent infringement will be more likely ``once the parties know what industrywide remedy the Federal Trade Commission will impose,'' Whyte said in his ruling. Time also is needed to determine what FTC findings to admit into the Hynix case, he said.

      Hynix says its argument will resemble the FTC's. Both say Rambus attended meetings of the Joint Electron Device Engineering Counsel, a memory-chip standards panel, without disclosing patents it would later enforce. Hynix claims the Rambus patents are unenforceable.

      $307 Million Award

      The FTC found that Rambus monopolized four aspects of an industry standard for memory chips. The ruling threatens to reduce Rambus's ability to collect royalties that provide 80 percent of its revenue.

      Rambus and the FTC staff have to submit arguments by Sept. 15 on whether the company should be barred from getting royalties on memory chips that comply with the standard.

      Rambus spokeswoman Gabriele Collier didn't immediately return a call seeking comment.

Bis dahin rambus unter 10 Dollar?, würde mich nicht wundern, füre den Kursanstieg der letzten Tage darauf zurück das auf einen positiven Phase 3 Ausgang gepokert wurde.

      Kurz-Kommentierung: Die Rambus Aktie rutschte wie erwartet bis an die Zielzone bei 9,45 - 10,22 $ zurück, wo sie vergangene Woche nach oben hin abprallte. Aktuell erreicht sie den Widerstandsbereich bei 12,23 - 12,54 $, wo sie nach unten hin abprallen sollte. Erstes Ziel wäre der Bereich um 11,00 $. Im Idealfall wird ein neues Zwischentief im Bereich bei 9,45 - 10,22 $ markiert, bevor im Herbst eine ausgedehnte Aufwärtskorrektur bis 15,50 - 17,90 $ gestartet werden sollte. Unter 9,00 $ drohen weitere Abgaben bis 6,64 $. Steigt die Aktie hingegen direkt auf Tages- und Wochenschlussbasis über12,54 $ an, wird weiteres Aufwärtspotenzial bis zunächst 14,63 $ generiert.
