WTO Rules U.S. Web Gaming Ban Illegal, Offers Industry Hope

March 30 (Bloomberg) -- The U.S. ignored a ruling that
found it discriminates against foreign gambling companies by
banning payments to gaming Web sites while allowing bets on its
own soil, the World Trade Organization's highest judges said.
Antigua and Barbuda, a Caribbean nation of 80,000 people
and the smallest government ever to lodge a WTO complaint,
scored an initial victory against U.S. online gambling
restrictions when the WTO found in April 2005 that the U.S. had
pledged to open the industry to competition 10 years earlier.
Today's ruling rejects a U.S. appeal against that.
The U.S. passed legislation five months ago to close the
estimated $12 billion global business to domestic residents, who
account for half of the market. The U.S. banned credit card
companies from processing payments to betting sites such as
Sportingbet Plc, Leisure & Gaming Plc, PartyGaming Plc and
Empire Online Ltd., which then ceased U.S. operations or sold
them for nominal amounts.
Today's ruling ``offers hope to the global online gambling
industry currently under siege by the U.S. Department of
Justice,'' Antiguan Finance Minister Errol Cort said in an e-
mailed statement. ``It vindicates all that we have been saying
for years about the discriminatory trade practices of the United
States.''
The U.S. agreed that today's ruling finds it failed to
comply with the two-year old decision.
Still, the U.S. says the report allows it to maintain a ban
on Internet gambling to ``protect public order and public
morals'' as long as it doesn't discriminate against foreign
companies, Gretchen Hamel, a spokeswoman for the U.S. Trade
Representative's office in Washington, said in an e-mailed
statement. ``We are currently reviewing our options,'' Hamel
said.
The U.S. has argued that the prohibitions pre-dating the
October law apply to both foreign and American betting services,
and the WTO's decision only applies to gambling on horseracing,
which is allowed to discriminate against foreign companies.
The U.S. adds that its latest law isn't covered by the WTO
ruling and said that its 1995 commitment to open gambling to
foreign companies was an oversight by the Clinton
administration.
Drop in Income
Income for the 32 registered online casinos in Antigua and
Barbuda has fallen to $130 million a year from $1 billion in
2000, the Antiguan government says. The country developed online
gambling to boost a tourism-dependent economy after several
hurricanes in the 1990s.
Antigua successfully argued in its complaint that the U.S.
protects a domestic gambling industry while failing to live up
to its international commitments.
Charlie McCreevy, commissioner for the European Union's
internal market, labeled the U.S. law ``a protectionist
measure'' on Jan. 30, saying the EU should complain to the U.S.
after Congress passed the legislation barring credit card
companies from processing payments. President George W. Bush
signed the measure into law on Oct. 13.
`Smashing Success'
At the time, U.K. Culture Secretary Tessa Jowell compared
the U.S. law to the American alcohol ban of the 1920s, saying
the measure may force online gambling underground into an
unregulated black market.
``This is a smashing success for Antigua in every possible
way,'' John Ashe, the Caribbean island nation's ambassador to
the WTO in Geneva, said in a statement. The ruling clears up
``any lingering doubt that Antigua has obtained a clear and
convincing win over the United States and it is now time for the
United States to meet its international trade obligations.''
Antigua may seek sanctions in the form of withdrawing
intellectual property protection for U.S. trademarks or
copyright. Known as ``cross-retaliation,'' such sanctions are
legal at the WTO when an economy can't afford to impose
sanctions in the form of higher customs duties on goods.

Frank to Propose Gaming-Ban Repeal in U.S. House Soon

April 12 (Bloomberg) -- House Financial Services Chairman
Barney Frank said he will propose in ``the next couple weeks''
repealing an online-gambling restriction enacted by the U.S.
last year, criticizing the law as a curb on personal freedom.
Frank's measure would wipe away legislation outlawing
credit-card payments to Internet gaming sites, the Massachusetts
Democrat told reporters in Brussels today after meeting with
European Union lawmakers.
The prospect of a repeal has helped Internet gaming stocks
regain value they have lost since Congress passed the ban on
processing payments to gaming Web sites on Sept. 30. PartyGaming
Plc, the world's biggest Internet poker operator, has gained
more than 48 percent since Frank suggested a repeal in the
Financial Times newspaper on March 14.
The law was ``one of the stupidest things I ever saw. And I
want to get it undone,'' Frank said today. ``A reconsideration
among my colleagues is beginning.'' Frank, saying he needs time to win support, declined to
predict when his committee will consider the bill. A repeal
would require majority votes in the full House and Senate plus
the signature of President George W. Bush, who signed the
gambling-payment ban into law Oct. 13.
``I'm not going to move it yet because I think at this
point not enough minds have changed,'' he said. Frank, 67, said
members of Congress are hearing complaints from voters unable to
play poker and other games online, and he expects those
complaints to continue.
Gaming Stocks Gain
Other gaming companies whose stock prices have gained since
Frank's March 14 comments include 888 Holdings Plc, Sportingbet
Plc, Bwin Interactive Entertainment AG and Playtech Ltd., which
develops online-gambling software.
The shares also have been affected by a March 30 World
Trade Organization ruling that the U.S. ban violates
international trade rules.
Frank said his proposal would address only last year's bar
on payments to online-gambling sites. He said his committee
doesn't have jurisdiction over an earlier, broader U.S.
prohibition on Internet gambling.
Enforcement of the earlier law led to arrests of two
executives of foreign Internet gaming companies at U.S. airports
last year. Frank today called the detention of a foreign
executive while changing planes ``one of the most Stalinist
things I've ever seen my government do.''
Executives Charged
David Carruthers, then chief executive officer of
Betonsports Plc, was detained July 17 at a Dallas-area airport
while changing planes on a flight to Costa Rica from the U.K. He
faces federal racketeering and gambling charges.
Peter Dicks, then chairman of Sportingbet, was arrested
Sept. 6 at New York's John F. Kennedy International Airport
after he got off a flight from London. Dicks was freed Sept. 29
after a New York judge rejected an extradition request by
Louisiana.
Frank said he discussed the Internet gambling issue with
Charlie McCreevy, the EU's internal market and services
commissioner, who has criticized the U.S. stance as
protectionist.
Speaking after meetings with McCreevy, European Parliament
members and national regulators this week, Frank also said he
backs mutual recognition of rules to eliminate duplicate
regulation in areas including accounting and stock exchanges.
Frank said more U.S. politicians should follow the lead of
European policymakers in challenging leveraged buyouts by
private-equity investment funds, which he criticized for
pressuring companies to cut jobs.
``I would be pleased if some of that social concern would
rub off,'' Frank said. Among European advantages he cited is a
U.K. practice of giving pension overseers a role in considering
takeover offers.

Hat bet at home keine Lizenz für Österreich? das kann ich nicht glauben... Bwin hat auch eine izenz für Österreich aber auch eine für Gibraltar (dort ist das Steuer el dorado für glücksspiel bwin zahlt dort knapp 1 Prozent!!!! Siehe auf youtube gibt es ein video von bwin mit stellungnahme von Teufelberger ==> unbedingt ankuken)

Altenholz, 18. April 2007 - Die haushalts- und finanzpolitischen Sprecher
der Unionsfraktionen in den Bundesländern und der CDU/CSU-Fraktion im
Bundestag haben gestern auf einer Sitzung in Stuttgart beschlossen, dass
der Lotteriemarkt unverändert bleiben soll, da dieser bereits in einem
Staatsvertrag von 2004 reguliert ist. Die Bedingungen für einen
liberalisierten Sportwettmarkt sollen in einem gesonderten Staatsvertrag
geregelt werden. Die Unions-Sprecher folgen damit dem Vorschlag der Kieler
CDU-Landtagsfraktion, die im März einen Gesetzesentwurf zur Liberalisierung
des Sportwettmarktes vorgelegt hatte.
'Wir begrüßen den Beschluss der Union ausdrücklich', so Rainer Jacken,
Vorstandssprecher der FLUXX AG. 'Denn er zeigt, dass die Vernunft und
wirtschaftliche Realität im Zusammenhang mit dem geplanten
Glücksspiel-Staatsvertrags immer mehr an Boden gewinnt. Wir sehen bei
Gerichten und in der Politik zunehmend die wachsende Tendenz, dass die
erheblichen Bedenken der EU-Kommission jetzt Ernst genommen werden. Niemand
will mehr ohne Not auf erhebliche Einnahmen verzichten und für ein zu
erwartendes Rechtschaos in Deutschland und Europa verantwortlich sein. Von
uns Bürgern wird zu Recht Gesetzestreue verlangt - das müssen wir dann auch
von Politikern erwarten können. Mit diesem weisen Beschluss der
Unions-Finanzpolitiker steht einer intelligenten Neuordnung des deutschen
Glücksspielmarkts nichts mehr im Wege.'
Mit der Liberalisierung der Sportwetten soll nach den Vorstellungen der
Finanzpolitiker der Union eine so genannte Lenkungssonderabgabe eingeführt
werden. Sie soll nach dem Wohnort des Spielers erhoben werden und den
Bundesländern ihre Einnahmen aus den Sportwetten sichern. Damit sollen
weiterhin Breitensport, Wohlfahrt und Kultur sowie
Suchtpräventionsmaßnahmen unterstützt werden.

der Lotteriemarkt unverändert bleiben soll, da dieser bereits in einem
