re: News: Lynas shares hit by approval doubts (NightStalker)
...
There is an enormous difference between "REFUSED A LICENSE" and "NOT YET ISSUED A LICENSE".
This would have to be "rumourtrage" by those wanting to make a quick profit by shorting. And/or yet more sneaky, underhanded cynical moves by Fuziah Saleh and her crew of mis-information spreaders. The same ones that would have primed the New York Times for that disgustingly wrong article that sent the shares plummeting earlier this year....
BUT - the response from Lynas was so weak, that it did nothing to reassure the market. They could have pointed out the difference between "Refused" and "Not yet issued" in much more strongly-worded and clear terms. I understand that they have a thin line to tread so as not to appear to be putting pressure on the Malaysian Govt, or to appear to be pre-empting them, but they could have done much more to stop the panic.
Fuzzy and her cronies, along with the hedgies, would have been rubbing their hands with glee...!

Hi all just noticed this comment #77 from the AELB posted 2 hours.
DG AELB• 2 hours ago
Thank you everyone for the constructive comments.
At the outset, let me introduce two minor editorial amendments in the article. First, insert a comma after "report" in the sentence "In a published report, on June 28, 2011, an International Atomic Energy Agency review team...." and second, delete "are" in another sentence for it to read "Bearers of these positions are......."; and I regret these errors.
Contrary to seditious rumours, let me assure you that AELB is in the process of carefully studying the pre-operating stage documents submitted by Lynas. These are very important documents as they are legal submissions made by Lynas as to what they claim to, shall and must do to be in full compliance. Until deemed satifactory by AELB, they will have to be amended, augmented and re-submitted by Lynas. Some had been re-submitted several times to date. Subsequently, an inter-agency panel of experts will then further scrutinise the accepted documents. The Panel includes experts from the Department of Environment (DOE), Ministry of Health (MOH) and several others. After careful review, including interviews with Lynas, this Panel and AELB will then submit recommendations to the 5-AELB Board for a decision. As practised in many other States, once approved the public will be shared the documents by the applicant for comments.
If and when a Pre-Operational License is issued, taking into account credible public comments, if any, AELB will use the conditional and controlled pre-operational stage to further collect and verify the plant's operational safety data that almost everyone has been asking for i.e. how much and what is the radioactive content of the residue, what is is heavy metal content in each residue component, what if mass input does not balance with the mass output, can the plant be safely operated, should the plant be corrected before further trial runs, etc.
Now turning to the issue of consistency, please note that AELB and I have have tried our utmost to be very consistent throughout this episode but have always been misreported. We have always stated that if national and international requirements are met at each and every stage of the multi- licensing process, Lynas will be allowed to operate. Failure or non-compliance would either mean non-issuance of license or suspension of operation and license. All regulatory decisions are based on legal technical considerations and provisions derived from best practises, international standards and national requirements or regulations.
On the issue of residues produced or processed, AELB and I have also constantly stated that if the specific radioactivity level is similar to background or is less than the internationally set level of 1 Becquerel per gramme, residues may be released from the regulatory control of AELB. This, however, does not mean out of DOE's control. Heavy metal content and other non-radioactve contaminants must be below the stipulated levels for it to be released from separate DOE legal requirements. Please note that any one time there can be at least 4 regularatory authorities monitoring and verifying the operations.
On IF's and MAYBE's, it is important to note that in any risk management, these type of assumptions are critical for planning state of preparedness. As examples, in nuclear power reactor safety design, what IF a tsunami ensues directly after a devastating earthquake. In car insurance, MAYBE the insured sum is inadequate. This useful and essential academic exercise on IF's and MAYBE's goes on until economic considerations requires a halt.
By the way, the 4 radiation workers that were previously contaminated in the medical cyclotron facility are now at work, continuing to provide radiopharmaceuticals for patients at more affordable prices in Malaysia, which otherwise would have costed the affected local population 6-7 times more per medical imaging procedure if imported. AELB will continue to monitor all radiation workers health while at the same time respecting their privacy. Act 304 requires that we monitor radiation workers and keep health records for 30-year periods to ensure safety, as well as, facilitate accountability, liability and compensation, if legally appropriate.
Lastly, everyone is welcome to come by AELB to check out if AELB and I are real, credible and doing our level best to serve you and to keep you and your family radiologically safe.

Lynas shares hit by approval doubts
October 20, 2011 07:43 AM
Shares in Lynas Corporation Limited (ASX:LYC) shed almost 10 per cent of their value yesterday after reports emerged that the rare earths developer had been refused a licence to import rare earths ores into Malaysia.
Lynas is planning to ship rare earths concentrate from its Mt Weld mine in Western Australia to its Malaysian refinery.
Reports emerged yesterday that the Malaysian Government said that, ''Lynas was neither issued a license… nor does it qualify yet for a permit to import rare earth ores into Malaysia”.
Lynas addressed the speculation just before the market closed, telling the Australian Securities Exchange that as far as it was aware Malaysian authorities had made no decision concerning the pre-operating license and importation of rare earths ores into the country.
Lynas also advises that no decision is expected to be made for some weeks.
Yesterday shares in Lynas shed 9.92 per cent, closing at $1.09.
In the 2011 financial year Lynas Corporation booked a net loss of $59 million.

Lynas slumps on Malaysian rumour of import licence refusal
RARE earth miner Lynas's shares slumped yesterday on speculation that it had been refused a licence to import ore into Malaysia for processing, as protests against its plant continued.
Lynas shares fell up to 13 per cent after the government's announcement before rebounding slightly to close 9.92 per cent lower at $1.09 as the company raced to clarify the claims.
Malaysia's ministry of international trade and industry and the ministry of science, technology and innovation issued a joint statement yesterday to reaffirm that Lynas had not yet been given permission to import ore.
The statement was made after protesters had incorrectly claimed the miner planned to start importing this month.
Lynas also moved to assure local residents the claims were inaccurate, as it was still working with the government to obtain a pre-operating licence before it could proceed with shipments.
...
Despite the community opposition, Mr Curtis said in August he was confident the company would be in production in Malaysia by the end of the year.
On September 30 Lynas said the first feed of concentrate at the Malaysian plant was still scheduled for the fourth quarter of this year
..
Lynas, which opened its Mount Weld mine in August, the first rare earth mine in Australia, has already allocated about 70 per cent of its 11,000 million tonnes from stage one of its project.

Lynas belum dapat kebenaran import bijih nadir bumi
19/10/2011 4:43pm
KUALA LUMPUR 19 Okt.

Lynas plays down fears of China rare earths plot
By Peter Smith in Sydney
When Nick Curtis was invited to the World Economic Forum in Davos this year, there was one topic that political and corporate chiefs wanted him to address.
How could the world guarantee a steady supply of rare earths, the 17 elements crucial for many of the electronics used in everyday life, at a time when China controlled more than 90 per cent of global production?

AELB’s top priority is radiation and nuclear safety
October 18, 2011
In the case of Lynas in Kuantan, if safety is a concern to locals then it is also a concern for AELB, if not more.
By Raja Dato’ Abdul Aziz Raja Adnan
...
...
AELB’s first priority is safety
In a published report on June 28, 2011, an International Atomic Energy Agency review team which made an extensive analysis of available Malaysian regulations and applicable documents concluded that the national legal and regulatory framework was in compliance with the international radiation safety standards pertaining to a rare earth extraction industry.
The present AELB director general is a member of the current IAEA Commission of Safety Standards (CSS), the highest international forum for setting global nuclear and radiation safety standards.
This CSS expert membership is by virtue that he is the current Chairman of the Advisory Group on Nuclear Security (AdSec) to the IAEA Director General, His Excellency Yukiya Amano. Bearers of these are positions are considered purely based on merits and considered a first by any Malaysian.
Several AELB personnel are recognised by the IAEA as either subject matter specialists, experts or consultants at either regional or global level.
In short, at AELB, we have the expertise to ensure that Malaysia is safe, secured and safeguarded in the peaceful uses of atomic energy.
In the case of Lynas in Kuantan, if safety is a concern to locals then it is also a concern for AELB, if not more.
Earlier this year, AELB through the Science, Technology and Innovation Ministry (MOSTI) played a major advisory role during the Fukushima accident.
AELB was advising Malaysians on the evolving situation. It was scanning for possible radioactive contamination of human, environmental and international transport at all points of entry.
It also sampled air, soil and water contamination to assure safety. Radiation and nuclear safety is first in AELB and will always be.

AELB’s top priority is radiation and nuclear safety

In the case of Lynas in Kuantan, if safety is a concern to locals then it is also a concern for AELB, if not more.
