NEW YORK (Reuters) - Samuel Waksal, the founder of ImClone Systems Inc., was sentenced on Tuesday to more than seven years in prison for orchestrating an insider trading scheme the judge said undermined confidence in corporate America.
U.S. District Judge William Pauley ordered Waksal, 55, to serve the maximum 87 months in prison and pay the top fine of $3 million. In addition, he ordered Waksal to pay $1.26 million in restitution. The insider trading scheme led to last week`s indictment of Waksal`s good friend, style-setter Martha Stewart (news - web sites).
Pauley harshly criticized ImClone`s former chief executive for the harm he caused to his family, co-workers, the investing public and cancer patients who are awaiting the development of the company`s cancer-fighting drug, Ebitrux.
"You abused your position of trust as the chief executive officer of a major corporation and undermined the public`s confidence in the integrity of the capital markets," Pauley said. "Then you tried to lie your way out of it ... you even jeopardized the well being of your family ... the harm you wrought is incalculable."
The judge ordered Waksal to surrender on July 2 and said he must wear an electronic monitoring bracelet and remain under house arrest until he goes to prison.
Waksal was indicted for trying to sell his ImClone shares ahead of a public announcement that the U.S. Food and Drug Administration (news - web sites) would reject the company`s highly touted cancer drug. Erbitux is still under development but has recently shown signs of success.
The indictment also charged Waksal with perjury, bank fraud and obstruction of justice for lying to investigators to cover up the scheme. In addition he was charged with evading sales tax on $15 million in art work.
In sentencing Waksal, Pauley rejected defense arguments that Waksal`s crimes were "spur of the moment" weaknesses and that he should not be compared with defendants in major accounting fraud cases involving former executives at WorldCom and Enron.
Waksal is the first chief executive to be sentenced in the spate of corporate scandals that have shaken faith in American business, resulted in huge losses for investors and spurred calls for an overhaul of corporate governance.
Pauley said the ImClone founder`s crimes "are not simply a 24-hour window of catastrophic poor judgment or a crime of impulse rather these crimes are emblematic of a pattern of lawlessness and arrogance from your own self description of a short term cash flow needs."
Prior to his sentencing, Waksal addressed the court and apologized to family, ImClone employees, shareholders and cancer patients. Members of his family attending the hearing at a federal courthouse in lower Manhattan were emotional, and some cried.
"First and most importantly, I want to apologize for my wrongdoing. I am deeply disturbed and so very sorry for my actions," said Waksal, who kept clearing his throat and tried to gain composure in front of a packed courtroom.
He also apologized to his parents, who are Holocaust survivors. "They survived so much, they didn`t need me to inflict pain at this point in their lives," he said.
Waksal pleaded guilty last October to six felony counts related to insider trading, and in March he pleaded guilty to sales tax charges.
Stewart, a friend of Waksal`s and chief executive of Martha Stewart Living Omnimedia Inc., was dragged into the investigation in June 2002 when news surfaced that she had sold nearly 4,000 ImClone shares in December 2001, just before the bad news about Erbitux came out. Stewart was indicted last week on charges of securities fraud, conspiracy and making false statements to federal agents. She pleaded not guilty.

New York - Samuel Waksal, Gründer und Ex-Chef von ImClone Systems wurde am heutigen Dienstag zu 87 Monaten Haft und zur Zahlung von drei Millionen Dollar Strafe sowie 1,26 Millionen Dollar Entschädigung verurteilt.

Waksal hatte Steuern hinterzogen und zudem mit Optionen auf ImClone-Aktien spekuliert, bevor die Titel an der Börse aufgrund einer Zulassungsverweigerung des Medikaments Erbitux eingebrochen waren. Damit ist nach Ansicht der Richter der Tatbestand des Insider-Handels erfüllt gewesen. Ob Waksal in Berufung gehen wird, wurde bislang nicht bekannt.
Das Bezirksgericht in New York argumentierte, Waksal habe bei seinen Börsen-Engagements, die auf einen fallenden Aktienkurs des Unternehmens abzielten, sich und seine Familie bereichern wollen. Waksal ist damit der erste Unternehmenschef in den USA, der im Zuge der Bilanzskandale zu einer Haftstrafe verurteilt worden ist. Die Affäre zwang auch Waksals Geschäftspartnerin Martha Stewart, Gründerin der börsennotierten Firma Martha Stewart Living , zum Rücktritt. Die TV-Größe in den USA hatte von Waksal den Ratschlag zum Verkauf von Imclone-Aktien bekommen, kurz bevor bekannt wurde, dass das Krebs-Medikament nicht zum Verkauf zugelassen werden würde.
Erfolg von Erbitux bahnt sich zwei Jahre später an
Waksal hatte sich in dem Gerichtsverfahren schuldig bekannt zu Insiderhandel, Bankbetrug und Steuerhinterziehung.
Ironie des Schicksals: Nachdem der Konzern Anfang Juni erneut eine Zulassung bei der US-Behörde FDA (Food and Drug Administration) für das Medikament Erbitux, fährt der Aktienkurs von ImClone eine Kursrallye, die an einigen Tagen zweistelligen Zuwächse für den Titel brachte.
Der deutsche Partner von Imclone, die Darmstädter Merck KGaA hatte sich kürzlich mit dem Verlauf einer Studie über die Wirksamkeit des Krebsmedikamentes zufrieden gezeigt. Das Präparat habe in Kombination mit Irinotecan (Chemotherapie) bei 22,9 Prozent der Patienten zu einer Rückbildung von Tumoren um mehr 50 Prozent geführt.
