      Liebes Tagebuch,

      heute las ich doch zwecks Bearbeitung der Lösung meines mir im Rahmen einer Hausarbeit vorgegebenen Sachverhalts im Lehrbuch des altehrwürdigen Prof. Dr. iur. Dr. h.c. Dieter Medicus, der sein Werk mit dem liebevollen, aber trotzdem im Stile eines waschechten Voll- und Berufsjuristen gewählten, sachlich-nüchternen Titel "Schuldrecht I, Allgemeiner Teil" zu versehen gedachte, eine Randnummer mit folgendem Wortlaute: "Schon als Student habe ich nicht einzusehen vermochte, warum diese oft nur zufälligen Unterschiede zu einer völlig verschiedenen rechtlichen Behandlung führen sollen, wie das dem alten Recht entsprach." Der Herr Professor spricht hier von der Änderung der rechtlichen Behandlung der sogenannten Unmöglichkeit einer Leistungserbringung durch den Schuldner durch das Schuldrechtsmodernisierungsgesetz, die nicht mehr nach anfänglicher, nachträglicher, subjektiver oder objektiver Unmöglichkeit unterscheidet. Bei diesem Satz kam mir spontan der Gedanke: Du hattest also prominente Leidensgenossen beim Verständnis des alten Schuldrechts! Was ich dann (weiter-)las, vermochte meine schon heitere Stimmung, nebst des sonnigen Frühlingswetters, noch zu steigern, und möchte ich es Dir, liebes Tagebuch, in die Annalen schreiben: "Zuzugeben ist freilich, dass die Berechnung des Schadenersatzes statt der Leistung, bei manchen objektiv unmöglichen Leistungen schwierig sein kann, weil für sie ein Marktpreis fehlt. Es möge etwa ein Perpetuum mobile versprochen worden sein. Dessen Wert wäre, wenn es denn wirkliche funktionierte, geradezu unermesslich." (Rn. 493) Hierbei kam mir die spontane Assoziation, wie hoch wohl der Schadensersatz für eine versprochene "Met@box1000" sein müsste und dass darin wohl der wahre Grund für die Insolvenz der gleichnamigen kleinen Softwareschmiede zu suchen sei: Die Schadenersatzforderungen der geprellten Großkunden. Damit möchte ich für heute schließen, liebes Tagebuch, denn vielleicht habe ich als Met@boxaktionär, wie Du am besten weißt, nicht mehr allzu viel zu lachen heute.

      wenn ich lese, dass ein Freiflieger Texte von Strohmann zum Brüllen findet, dann weiss ich, er hat sich wieder über sein Hühnerfrikassee hergemacht und wartet, was da so kommen mag. Denn er ist sich wohl immer noch sicher: Es commt, wie es commt :laugh:

      Richtig, liebes Tagebuch!

      Metaschrott ist meine Lieblingsaktie und sie wird mir einst gütigerweise ein Sümmchen zur Verfügung stellen, das mich in die Lage versetzt, das folgende Kleinod bar bezahlen zu können:



      Rechts- und wirtschaftliche Macht ist das eine, ihre Ausübung das andere! Apropos, heute macht mir das Studieren wieder sehr viel Freude, noch mehr als gestern schon, da es mir wieder sehr viel besser geht. Gesundheit ist doch das höchste Gut, findest Du nicht, liebes Tagebuch? Ich arbeite also fleißig an meiner Hausarbeit und meiner persönlich-spirituellen Erleuchtung, die auch gute Fortschritte zu verzeichnen hat. Von meinem spirituellen Erlebnis habe ich Dir ja schon ausführlich am 02.02.2004 erzählt. Ein denkwürdiger Tag und denkwürdig ist auch die Entscheidung bezüglich des Vehikels, das der Untersatz für meinen süßen Popo sein wird. Über obig dargestelltes Geschoss habe ich in der vorletzten Ausgabe der Welt am Sonntag einen Bericht gelesen. Ohne eine Probefahrt lässt sich jedoch nur über das Äußere und die Daten eine Vorauswahl treffen. Da ich Dich als sehr empfänglich für ästhetische Fragen kennengelernt habe, möchte ich Dich aus meiner ersichtlichen Ratlosigkeit heraus deshalb um eine Hilfestellung bei dieser Sache bitten. Hilf mir! Ich weiß noch ein, noch aus. Aber vielleicht fällt die Wahl auf beide den Ferrari Challenge Stradale und den Porsche Boxster? Was meinst Du, kommt noch ein Maserati oder gar Lamborghini hinzu? Gibt es in Italien eigentlich auch kein Tempolimit auf Autobahnen?

      Querido diario,

      jetzt, wo ich meine Hausarbeit abgegeben habe, habe ich auch wieder mehr Zeit für Dich, liebe Tagebuch. Wie hast Du die Ostertage verlebt? Ich habe ein wenig die Sonne und die Damenwelt genossen und alles von zuhause aus. Tirol? Wie frivol! Nein, ich kann mich hier in der Stadt der Göttin(g)en nicht beklagen. Vorgestern habe ich einen Maserati, wie nachstehend in freier Wildbahn bewundern dürfen. Das Motorengeräusch ließ mich allerdings von einer künftigen Investition in selbiges Gefährt Abstand nehmen:



      Außerdem gefällt mir das Heck nicht. Die wissen schon, warum sie das nicht zeigen. Nun gut, aber ich muss mich ja dank meines Investments in meine Lieblingsaktie Metaschrott ("Schrotthandel ist meine Passion, seit Jahren schon!" ) nicht dagegen entscheiden. Dafür gefallen mir die Hecks der weiblichen Fahrgestelle umso mehr. Passend dazu die aktuelle Ausgabe des Playboy:



      Für mein leibliches Wohl ist also gesorgt, wie Du siehst, liebes Tagebuch. Damit erst einmal Schluss für heute.

      Guten Morgen,

      meinen heutigen Eintrag in Dich, liebes Tagebuch, nehme ich zur Gelegenheit, meine Kommilitonen und besonders die Dozenten der Juristischen Fakultät Universität Göttingen zu grüßen. Seid gegrüßt!

      So, um 9 Uhr c.t. (cum tempore - "akademische Viertelstunde" ) gleich Bruns Kapitalgesellschaftsrecht. Mal sehen, ob der mir noch was beibringen kann! ;) ... und, ob Bruns als Neuling an der Elite-Fakultät Jura an der künftigen Elite-Universität Göttingen (Schröder ist Absolvent dieser und Duz-Freund des (noch) amtierenden Uni-Präsidenten Horst Kern, der hiermit auch herzlich gegrüßt sei! (ein ganz spezieller Freund meiner)) die schmerzliche Lücke füllen kann, die Herr Prof. Fleischer riss, als er aus persönlichen Gründen einem Ruf in seine Heimat an die Universität Bonn folgte.

      Stansfield, or Stan, from the very beginning of Léon appears as a very `over the top` character; he`s a very eccentric, intense sort of villain -- the kind that gives all the other characters the `creeps`. He likes to make chit-chat, especially about Classical composers, and can appear very friendly and welcoming until the moment comes when he loses his temper.

      He takes these little yellow and green pills which he cracks by bending backwards freakishly -- this only adding to his `creepy` factor XD The pills seem to turn him a little more psychotic than usual, as well as impairing his judgement. He`s frequently told to `calm down` after taking these pills. Overall, he`s just a very crazy and thus amusing and perfect villain.

      Probably one of the main reasons why I like the character Stansfield so much is that he`s played by Gary Oldman. This was one of the first films I saw (and recognised) him in, and it pretty much cemented my fascination with him as an actor. It`s become one of my favourite roles of his, and I just never get tired of watching the film.

      Bum:

I could never stand to see anyone like that whatever his age might be. But more especially when he was real old like this one was.

      Bum:

      Alex:

      Wife:

      Alex:
      Excuse me misses can you please help? There`s been a terrible accident. My friend`s in the middle of the road bleeding to death. Can I please use your telephone for an ambulance?

      Wife:
      I`m sorry, but we don`t have a telephone. You`ll have to go somewhere else.

      Alex:
      But misses it`s a matter of life and death.

      Writer:
      Who is it dear?

      Wife:
      There`s a young man here he says there`s been an accident. He wants to use the telephone.

      Writer:
      Well I suppose you`d better let him in.

      Wife:

      Alex:
      Right, Pete check the rest of the house. Dim.       We were all feeling a bit shagged and fagged and fashed, it having been an evening of small energy expenditure, O my brothers. So we got rid of the auto and stopped off at the old Korova for a nightcap.

      Dim:
      Hello Lucy. Had a busy night? We`ve been working hard too. Pardon me Luse.

      Alex:
      There was some sophistos from the T.V. Studios around the corner. Laughing an govoreeting the Devotchka was smecking away and not caring about the wicked world one bit. Then the disk on the stereo twanged off and out and in the short silence before the next one came on she suddenly came with a burst of singing. And it was like for a moment, O my brothers, some great bird had flown into the milk bar and I felt all the malenky little hairs on my plott standing endwise and the shivers crawling up like slow malenky lizards and then down again. Because I knew what she sang. It was a bit from the glorious 9th, by Ludwig Van.

      Dim:
      What did you do that for?

      Alex:
      For being a bastard with no manners. Without a dook of an idea about how to comport yourself public-wise, O my brother.

      Dim:
      I don`t like you should do what you done and I`m not your brother no more and wouldn`t want to be.

      Alex:
      Watch that. Do watch that O Dim, if to continue to be on live thou dost wish.

      Dim:
      Yarbles, Great Bolshy Yarblockos to you. I`ll meet you with chain, or nudge, or britva, any time, I`m not have you aiming tolchoks at me reasonless. It stands to reason, I won`t have it.

      Alex:
      And I`ll scrap any time you say.

      Dim:
      Right, right. Doobidoob. A bit tired may be best not to say more. Bedways is rigthways now, so best we go homeways and get a bit of spatchka. Right, right.

      Alex:
      Where I lived was with my Dada and Mum in meunichipal flat block 18-A Linear North. It had been a wonderful evening and what I needed now to give it the perfect ending was a bit of the old Ludwig Van. Oh bliss, bliss and heaven. Oh it was georgeousness and georgeosity made flesh. It was like a bird of rarest spun heaven metal, or like silvery wine flowing in a spaceship gravity all nonsense now as I slooshied I knew such pretty pictures.

      Mum:
      Alex, Alex, Alex, Alex.

      Alex:
      What do you want, Mum?

      Mum:
      It`s past eight Alex, you don`t want to be late for school son.

      Alex:
      Bit of a pain in my gulliver, Mum. Leave us be, and I`ll try and sleep it off. And then I`ll be as right as dodgers for this after.

      Mum:
      But you`ve not been at school all week, son.

      Alex:
      Got to rest, Mum. Got to get fit, otherwise I`m liable to miss a lot more school.

      Mum:
      Here I`ll put your breakfast in the oven. I`ve got to be off myself now.

      Alex:
      Allright, Mum, have a nice day at the factory.

      Mum:
      He`s not feeling too good again this morning, Dad.

      Dad:
      Yes, yes I heard, do you know what time he got home last night?

      Mum:
      No I don`t, when I take my sleepers.

      Dad:
      I wonder, where exactly is it he goes to work of evenings.

      Mum:
      Well, Like he says It`s mostly odd jobs he does helping like here and there as it might be.

      Alex:
      Hi, hi, hi, Mr. Deltoid. Funny surprise seeing you here.

      Mr. Deltoid:
      Well Alex boy awake at last yes? I met your mother on the way to work, yes? She gave me the key. She said something about a pain somewhere, hence not at school , yes?

      Alex:
      A rather intolerable pain in the head, Brother sir. I think it should be clear by this after-lunch.

      Mr. Deltoid:
      Or certainly by this evening, yes? The evening is the great time, isn`t it Alex boy?

      Alex:
      Cup of the old chai, Sir?

      Mr. Deltoid:
      No time, no time yes? Sit, sit, sit.

      Alex:
      To what do I owe this extreme pleasure, Sir? Anything wrong, Sir?

      Mr. Deltoid:
      Wrong? Why should you think of anything being wrong? Have you been doing something you shouldn`t, yes?

      Alex:
      Just a manner of speech, sir.

      Mr. Deltoid:
      Yes, well it`s just a manner of speech from your post corrective advisor to you, that you watch out little Alex. Because next time it`s not going to be the corrective school any more. Next time it`s going to be the Barley place with all my work ruined. If you`ve no respect for your horrible self, you at least might have some for me, who sweated over you. A big black mark I tell you for every one we don`t reclaim. A confession of failure for every one of you who ends up in the stripee hole.

      Alex:
      I`ve been doing nothing I shouldn`t, Sir. The millicents have nothing on me, Brother. Sir, I mean.

      Mr. Deltoid:
      Cut out all this clever talk about milicents. Just because the police haven`t picked you up lately doesn`t as you very well know mean that you haven`t been up to some nastiness.       Wenn sich nicht, liebes Tagebuch,

      mein Studium so überaus erfolgreich gestaltete, und meine einzige Hoffnung darin bestünde, dass sich mein mit MBX prall gefülltes Depot eines Tages aus Dreck in Gold verwandelte, könnte man der begründeten Ansicht sein, ich sei in der Tat ein hoffnungsloser Fall. Da ich jedoch meine Hausarbeit (BGB) gewohnt bravourös bestand ("magna cum laude" ), sowie auch die Klausur mit "sehr gut" bewertet bekam, sehe ich nicht nur der Aussicht MBXillionär zu werden, sondern auch einer aussichtsreichen Karriere als Wirtschafts-Anwalt oder Vorstandsvorsitzender einer börsennotierten Aktiengesellschaft gelassen entgegen. Wie man eine solche AG geschickt leitet, hat mir ein mir zum Vorbild gewordener Braunschweiger in den letzten Jahren praktisch, wenn auch leider für mich mit viel Lehrgeld verbunden vorgeführt. Aber was nichts kostet, ist nichts wert!

      Was die MBX Zeit mich lehrte, lässt sich vielleicht in folgendem "Lehrsatz" komprimieren: "Wunder geschehen, man darf sich nicht wundern."

      Kann ich nächstes Jahr den heutigen Tag als solcher begehen, wer wird meine Braut? Das Leben steckt voller Überraschungen, wenn man sich diese auch manchmal überraschend positiver gewünscht hätte. Dann waren eben die eigenen Erwartungen zu hoch!

      Des einen Freud ist des anderen Leid. Es heißt, sich mit anderen freuen zu lernen, wenn man selbst keinen Grund zur Freude hätte.

      Mein Entschluss indes, nach einer Karriere als Anwalt oder Unternehmer (s.o.) in die Politik zu gehen, festigt sich mit jedem Tag, an dem ich die Unfähigkeit der amtierenden Bundesregierung tatenlos mitansehen muss. Das deutsche Volk braucht mich, wenn es mich kennt, will es mich und ich werde es brauchen und wollen, um ihm dienen zu können, mit meiner ganzen Person! Ein Partei- und Wahlprogramm meiner "Partei für Deutschland (PfD)" steht in seinen Eckpfeilern bereits. Hierzu werde ich in Kürze die Öffentlichkeit informieren, natürlich erst nachdem ich dich um deinen mir teuren Rat bat.

      Sofern ich sterben sollte, was ja noch nicht ausgemacht ist, wird mir die Stadt und die Menschen Göttingens sicher ein Mausoleum errichten. Die Ehrung, die mir posthum zuteil werden wird, könnte jedoch kaum größer sein, als sie ohnehin jetzt schon ist. Nicht nur, dass mir Plakatierungen thematisch zugeeignet werden und mich wildfremde Menschen seit kurzem umarmen und meiner Schönheit und Genialität zu huldigen wünschen, ist mir neben der Festivität des gestrigen Tages jüngst die Ehrenbürgerschaft der Stadt Göttingen angedient worden. Eindrucksvolle und einzigartige Dinge geschehen allein in der Absicht, mein Gemüt zu erhellen und Freude auf mein Antlitz zu zaubern. Feuerwerk vor untergehender Sonne und die Widmung des Programms der ansässigen Kabarett-Szene sind nur Beispiele im schier unendlichen Katalog der Nettigkeiten, die mir zuteil werden. Hierfür bin ich dankbar, am meisten hat mich jedoch die Ehrenspielführerschaft des hiesigen Fußballvereins Göttingen 05 gefreut. Was bleibt noch übrig?

      Die Errichtung einer überlebensgroßen Statue, natürlich aus Gold, um die dann alle meine Anhänger und Verehrerinnen tanzen können, wenn ich einmal nicht für die Apotheose der Massen abkömmlich sein sollte, wenn ich z.B. mir die Zähne putze oder dem Somnam frönen sollte.

      Schröder, ich komme! Der nächste mittelmäßige Jurist aus Göttingens Eliteschmiede greift nach der Macht!

      Was kann mich jetzt noch aufhalten auf meinem Weg nach oben?

      Die Schwerkraft!

      Metabox-Chef verurteilt

      Der frühere Metabox-Chef Stefan Domeyer ist wegen Kursmanipulationen zu sieben Monaten Haft auf Bewährung verurteilt worden.

      Der 42-Jährige hat nach Ansicht des Hildesheimer Landgerichts im April 2000 mit falschen Angaben in einer Ad-hoc-Mitteilung den Kurs der damals am Neuen Markt notierten Metabox-Aktie in die Höhe getrieben. Das Gericht ordnete am Donnerstag außerdem die Zahlung von 10.000 Euro an.

      Metabox wollte den Internet-Empfang mit Hilfe so genannter Set-Top-Boxen über das Fernsehgerät ermöglichen. In der Pflichtmitteilung kündigte das Unternehmen den Verkauf von 50.000 Set-Top-Boxen an ein nicht näher benanntes Unternehmen an. Nach Erkenntnis der Richter gab es zu diesem Zeitpunkt jedoch nur einen unverbindlichen Vorvertrag mit einem israelischen Unternehmen. Das Geschäft wurde nie abgewickelt. Metabox ging später in Konkurs.

      " Der Angeklagte hat die Ad-hoc-Mitteilung zielgerichtet am Vorabend der Bilanzpressekonferenz veröffentlicht, um von den negativen Meldungen des Vorjahres abzulenken" , so das Gericht. Nach der Ad-hoc-Meldung stieg der Kurs von Metabox auf mehr als das Doppelte. Die Wirtschaftsstrafkammer zeigte sich überzeugt, dass der sprunghafte Kursanstieg durch die Mitteilung über den vermeintlichen Großauftrag ausgelöst worden war.

      Domeyer nahm die Urteilsbegründung mit Missfallen auf: Er tippte sich während der Ausführungen Moellers mehrfach mit dem Finger auf die Stirn. Der 42-Jährige hatte die Vorwürfe immer wieder bestritten. Das Urteil ist noch nicht rechtskräftig. Verteidigerin Claudia Riedel kündigte an, Revision einzulegen. Der frühere Vorstandsvorsitzende jobbt nach dem Zusammenbruch seiner Firma angeblich auf der Kart-Bahn eines Freundes in Braunschweig und lebt außerdem von Ersparnissen.

      Da ich Genanntes in Perfektion beherrsche, wie alles, was ich anfange, werde ich nun den Schwerpunkt meiner geistigen Forschungsarbeit auf die Gebiete Evolutionsbotanik, insbesondere "Maulwürfe und ihre Haufen", sowie die vier Rechenarten verlagern.       2.) Auch MBX wird noch Furore machen. Hierüber ist alles gesagt.

      2. ab und zu flucht, meistens über sich selbst ("Fluch macht kluch!")
      3. ab und zu ein Spässchen macht, meistens über sich selbst ("Spaß macht Spaß!")
      4. ab und zu ein Tänzchen wagt, meistens mit sich selbst ("Au lait!")
      4. Stanley Kubrick, Klaus Kinski, Marlon Brando, Rolf Zacher und die vielen anderen Genies, die ihm ebenbürtig sind, über alles verehrt

      sie gehen in meine Wohnung, sie machen mein Fahrrad kaputt, sie stören meine Nachtruhe, sie gehen an meine Sachen und hören Gespräche mit. Aber vor allem schwätzen sie! Wer sich nicht eine eigene Meinung von einem Menschen zu bilden imstande ist, wer sich an Gerede und Geschwätz über Menschen beteiligt, die man selbst gar nicht kennt, ist für mich abgeschrieben. Die Menschen interessieren mich immer weniger, dafür ekeln sie mich immer mehr an. Vertrauen kann man zu niemandem haben. Ich werde mich nun vollkommen aus der Öffentlichkeit zurückziehen, soweit dies möglich ist. Was meine Partnersuche anbetrifft, teile ich dir, liebes Tagebuch, mit, dass ich guter Dinge bin. Allerdings wird sie gewiss nicht aus Göttingen kommen. Ich werde dorthin gehen müssen, wo man mich nicht meint zu kennen. Denn kennen tut mich niemand. Weder in Göttingen noch anderswo.

      Traurig macht mich das nicht, ich habe mit nichts anderem gerechnet meinen bisherigen Erfahrungen mit Mitmenschen zufolge. Von Menschen möchte ich gar nicht mehr sprechen, Menschen sind Tiere für mich. Ich verstehe zwar ihre Sprache, aber sie sagen mir nichts. Aber hieraus den Schluss zu ziehen, ich sei einsam, ist falsch. Das Bewußtsein, Teil des Universiums zu sein, durchströmt mich in jedem Moment. Das macht stark und nicht einsam. Ich brauche niemanden. Meine Kraft kommt nicht aus der sozialen Anerkennung durch die anderen. Ich kann sie manipulieren, wie ich will. Denn alles, was geschieht, ist Produkt des Willens und Inbegriff des Vorstellungsvermögens.

      Auf solchem Niveau kann man ohnehin mit niemandem sprechen, ohne sich des Vorwurfes des Schwachsinns o. ä. schuldig zu machen.

      Wer interessiert sich heutzutage schon existenziell für Schopenhauer, Kant oder Nietzsche? (Es ist Kantjahr!)

      Die Menschen sind Tiere, außer der Unschuld der Seele. Die haben sie verloren.
