Ein Problem, das mir im Zusammenhang mit IFO auffällt: Als Argument für IFO wird immer wieder deren Plattform JNT und den "Lizenzeinnahmen, die daraus resultieren" genannt. Nun mal abgesehen davon, daß JNT kein Betriebsystem sondern lediglich eine Plattform ist ergibt sich auch aus dem public licence agreement für Linux ein Problem:
Nach Infomatecs eigenen Bekunden basiert JNT als auf Linux. Damit ergibt sich aber ein Problem. Linux, unterliegt (genauso wie die verschiedenen Mozilla Versionen) dem public license agreement, sind also durch die sogenannte GNU general public license geschützt. In dieser wird festgelegt, daß ALLE Programme, die Teile von Linux beinhalten, oder "darauf basieren" wiederum der Öffentlichkeit frei zugänglich gemacht werden müssen.
D.h. die source codes müssen zugänglich sein und es ist auch erlaubt, diese Software wiederum zu verändern und auf eigene Bedürfnisse umzuprogrammieren. Da JNT auf Linux basiert und auch Teile der Software auf Linuxteilen aufbaut bzw. diese beinhalten dürfte , müßte auch die Software von Infomatec der public license unterliegen.
Von Liznenzeinnahmen aus der Richtung JNT ist damit wohl nicht zu rechnen. Vielmehr ist damit zu rechnen, daß sich bald andere Hersteller von z.B. s.-t. boxen und thin clients diese Software zu Nutze machen dürften, wenn Infomatec sich an die public licence hält.
Infomatec stellt, meines Wissens, die source codes für JNT und die entsprechenden darauf basierenden Programme NICHT zur Verfügung. Eine entsprechende Anfrage meinerseits diesbezüglich wurde nicht beantwortet.
Gerüchteweise (Linux newsgroups) soll auch bereits von Seiten der free software foundation darüber nachgedacht werden, gegen Infomatec wegen dieser Praxis vorzugehen.

*lol Das ist also die Firma mit den grandiosen Aussichten! JNT das "Betriebssystem der Zukunft !!" Naja - mit Distribution lassen sich auch Umsätze machen! Kein Wunder, das IFO nur "Scheinkunden" im JNT Bereich hat. Aber sie haben ja auch andere Bereiche ...
Der Linux Kernel ist ja nur ein Teil vom JNT, IFO würde demnach für den `Mehrwert` Lizenzen verlangen, und das ist soviel ich weis legitim. Sonst könnte keine Firma mit Linux geld verdienen, oder?

Schätze, mit JNT verhält es sich änlich wie bei dem Windowmanager KDE. KDE basiert auf der QT-Bibliothek der Firma Troll Systems und diese ist nicht GPL konform.
Soll heißen, daß QT nur mit einigen Einschränkungen für die kostenlose Nutzung freigegeben ist, da dieses Produkt eigentlich kommerziell vermarktet wird.

Nö ! So wie ich das sehe, läßt sich mit Linux NUR Geld verdienen, wenn man es distributiert, d.h. Gebühren für den Vertrieb, die Kopie, die Systempflege, den Einbau verlangt. Die piblic licence (wenn ich es richtig verstanden habe - Punkt (0) und (2) erstreckt sich auf alle Programme, die Teile von Linux beinhalten (und sei es nur das kernel) oder darauf "aufbauen" (Zitat: "work based on...")

will ich ja gar nicht bestreiten. ich denke auch, daß sich mit der Distribution durchaus gutes Geld verdienen läßt. Aber darum geht es nicht. Es geht doch eher um das Problem, daß JNT (gerdae hier am board) immer wieder als das "Betreibssystem" der zukünftigen Netzwelt bezeichnet wird. Wenn es aber für jeden frei zugänglich ist, weiß ich nicht, wie man damit die "thin client " welt dominieren will. Zudem finde ich es auch nicht gut, wenn es stimmt und JNT source codes tatsächlich von IFO verweigert werden (was ich allerdings nicht glaube, wenn die Rechtslage so ist, wie sie hier dargestellt wird).

Unter diesen Umständen sehe ich auch den "Vorstoß" nach China eher bedenklich. Die haben sowieso schon kein großes Problem, Lizenzen zu unterlaufen. Bei JNT könnte das sogar ganz legal sein. Man nimmt den source code, verändert in in Kleinigkeiten und spielt ihn einfach auf "seine" Boxen. IFO sieht davon dan keinen Pfennig.

Erst einmal werden im Vorfeld die wesentlichen Grundsätze erörtert. Und bereits hier sehe ich einen solchen wesentlichen Grundsatz, wenns ums Lizensgeschäft geht. Es dürfte selbst Infomatec nicht entgangen sein, dass das Unternehmen wesentliche Umsätze mit dem Verkauf von JNT-Lizenzen generiert. Spätestens bei der genauen Sichtung des Vertragswerkes durch die Rechtsabteilung werden alle relevanten Gesichtspunkte genausestens unter die Lupe genommen. Würde danach ein akribisch geprüfter Vertrag durch die Vorstandschaft unterzeichnet werden, welcher zukünftige Lizenzeinnahmen verhindert, so hätten wir es nicht mit Konzernlenkern zu tun, sondern mit Dilletanten. ich hoffe, dass ich ein wenig Licht ins Dunkel bringen kann. Folgende eMail habe ich zu Infomatec gesandt. Wie gewohnt, wurde mir promt geantwortet, weshalb ich mich ausdrücklich nicht den Stimmen anschließen kann, welche gelegentlich über die Nichtbeantwortung von Anfragen klagen. Das Gegenteil ist der Fall. Hier wird schnell und zuverlässig der Aktionär mit den Antworten bedient, die ihn beschäftigen.

im Board von Wallstreet-Online wird rege darüber diskutiert, ob Infomatec berechtigt ist, für JNT Lizenzgebühren zu verlangen, nachdem diese Software zumindest in Teilen auf Linux aufbaut. Im nachstehendem Posting wird gemutmaßt, dass Infomatec gegen das public license agreement verstößt, wenn es den Source-Code von JNT nicht offenlegt. Meine speziellen Fragen finden sie im Anschluß an den in blau gehaltenen Bericht eines Boardteilnehmers:
Ein Problem, das mir im Zusammenhang mit IFO auffällt: Als Argument für IFO wird immer wieder deren Plattform JNT und den "Lizenzeinnahmen, die daraus resultieren" genannt. Nun mal abgesehen davon, daß JNT kein Betriebsystem sondern lediglich eine Plattform ist ergibt sich auch aus dem public licence agreement für Linux ein Problem:
Nach Infomatecs eigenen Bekunden basiert JNT als auf Linux. Damit ergibt sich aber ein Problem. Linux, unterliegt (genauso wie die verschiedenen Mozilla Versionen) dem public license agreement, sind also durch die sogenannte GNU general public license geschützt. In dieser wird festgelegt, daß ALLE Programme, die Teile von Linux beinhalten, oder "darauf basieren" wiederum der Öffentlichkeit frei zugänglich gemacht werden müssen.
D.h. die source codes müssen zugänglich sein und es ist auch erlaubt, diese Software wiederum zu verändern und auf eigene Bedürfnisse umzuprogrammieren. Da JNT auf Linux basiert und auch Teile der Software auf Linuxteilen aufbaut bzw. diese beinhalten dürfte , müßte auch die Software von Infomatec der public license unterliegen.
Von Liznenzeinnahmen aus der Richtung JNT ist damit wohl nicht zu rechnen. Vielmehr ist damit zu rechnen, daß sich bald andere Hersteller von z.B. s.-t. boxen und thin clients diese Software zu Nutze machen dürften, wenn Infomatec sich an die public licence hält.
Infomatec stellt, meines Wissens, die source codes für JNT und die entsprechenden darauf basierenden Programme NICHT zur Verfügung. Eine entsprechende Anfrage meinerseits diesbezüglich wurde nicht beantwortet.
Gerüchteweise (Linux newsgroups) soll auch bereits von Seiten der free software foundation darüber nachgedacht werden, gegen Infomatec wegen dieser Praxis vorzugehen.

Thema Linux, JNT und Lizenzeinnahmen.
Selbstverständlich sind wir uns der Tatsache bewußt, dass Linux eine
Open-Source-Software ist, die der GNU Public License unterliegt. Diese
GNU Public License ist uns bekannt und wird von der INFOMATEC AG
eingehalten.
Die erhobenen Lizenzgebühren stehen in Einklang mit der GNU General
Public License und der GNU Library Public License.
Einen Disput mit Linux führt die INFOMATEC AG nicht. Tatsächlich
unterstützt die INFOMATEC AG die Linux- und Open-Source-Gemeinde in
wesentlichen Aspekten. So hat die INFOMATEC AG mit anderen führenden
Unternehmen und Persönlichkeiten rund um Linux (z.B. SUSE) verbunden, um
die Europäische Kommission auf die Gefahren der von ihr angestrebten
Patentrechtsreformen aufmerksam zu machen. Die INFOMATEC AG hat sogar
ein eigenes Forschungsbudget bereitgestellt, um zeitgemäße und
alternative Schutzmöglichkeiten für Softwareentwickler und
Open-Source-Software zu initiieren, von der hauptsächlich die

ich hoffe, dass ich ein wenig Licht ins Dunkel bringen kann. Folgende eMail habe ich zu Infomatec gesandt. Wie gewohnt, wurde mir promt geantwortet, weshalb ich mich ausdrücklich nicht den Stimmen anschließen kann, welche gelegentlich über die Nichtbeantwortung von Anfragen klagen. Das Gegenteil ist der Fall. Hier wird schnell und zuverlässig der Aktionär mit den Antworten bedient, die ihn beschäftigen.
Sehr geehrte Frau Fischer,
im Board von Wallstreet-Online wird rege darüber diskutiert, ob Infomatec berechtigt ist, für JNT Lizenzgebühren zu verlangen, nachdem diese Software zumindest in Teilen auf Linux aufbaut. Im nachstehendem Posting wird gemutmaßt, dass Infomatec gegen das public license agreement verstößt, wenn es den Source-Code von JNT nicht offenlegt. Meine speziellen Fragen finden sie im Anschluß an den in blau gehaltenen Bericht eines Boardteilnehmers:
Ein Problem, das mir im Zusammenhang mit IFO auffällt: Als Argument für IFO wird immer wieder deren Plattform JNT und den "Lizenzeinnahmen, die daraus resultieren" genannt. Nun mal abgesehen davon, daß JNT kein Betriebsystem sondern lediglich eine Plattform ist ergibt sich auch aus dem public licence agreement für Linux ein Problem:
Nach Infomatecs eigenen Bekunden basiert JNT als auf Linux. Damit ergibt sich aber ein Problem. Linux, unterliegt (genauso wie die verschiedenen Mozilla Versionen) dem public license agreement, sind also durch die sogenannte GNU general public license geschützt. In dieser wird festgelegt, daß ALLE Programme, die Teile von Linux beinhalten, oder "darauf basieren" wiederum der Öffentlichkeit frei zugänglich gemacht werden müssen.
D.h. die source codes müssen zugänglich sein und es ist auch erlaubt, diese Software wiederum zu verändern und auf eigene Bedürfnisse umzuprogrammieren. Da JNT auf Linux basiert und auch Teile der Software auf Linuxteilen aufbaut bzw. diese beinhalten dürfte , müßte auch die Software von Infomatec der public license unterliegen.
Von Liznenzeinnahmen aus der Richtung JNT ist damit wohl nicht zu rechnen. Vielmehr ist damit zu rechnen, daß sich bald andere Hersteller von z.B. s.-t. boxen und thin clients diese Software zu Nutze machen dürften, wenn Infomatec sich an die public licence hält.
Infomatec stellt, meines Wissens, die source codes für JNT und die entsprechenden darauf basierenden Programme NICHT zur Verfügung. Eine entsprechende Anfrage meinerseits diesbezüglich wurde nicht beantwortet.
Gerüchteweise (Linux newsgroups) soll auch bereits von Seiten der free software foundation darüber nachgedacht werden, gegen Infomatec wegen dieser Praxis vorzugehen.

Die Antwort der Frau Fischer ist richtig. Da bisher keine Lizenzgebühren für jnt erhoben worden sind, stehen die erhobenen Lizenzgebühren mit der GNU usw. im Einklang. Das ist keine ausreichende Auskunft.
Tja,ein äußerst diplomatischer kommentar dieser firma.aber:ich habe mein taschengeld in infomatec gesteckt!also,baut kein sch.....
Der Fakt ist ,einen neuen Weltstandard setzen und haben sie in Augsburg absolut nicht
gesetzt !
Wenn man die jetzigen Pläne zu Biotech betrachtet,Bereitstellen der Forschungsergebnisse

Es wird nur eine FRAGE der Zeit ,bis die Ergebnisse zu JNT frei im Netz zu laden sind !

Zur Person: Ich bin selbst in ifo investiert und habe
seid 10 Jahren mit GNU Software zu tun.
Selten habe ich so einen Unsinn und ein grenzenloses
Halbwissen gefunden zum Theme GNU und GPL wie in diesem
Thread.
Und auf dieser Basis trefft Ihr Aktien-Kauf- und Verkaufs-
Entscheidungen? Naja, ist ja euer Geld.
Ein GNU/Linux-System verwendet einen Linux-Kernel.
Der Kernel unterliegt der GPL, will ich also den Kernel
aendern und das System dann verteilen, so muss ich
den Source zur Verfuegung stellen.
Auf dem System koennen GPL-Programme vorhanden sein,
aber auch andere. Die GPL gilt fuer die Bestandteile
unveraendert, aber nicht fuer das System insgesamt.
Manche Distributionen (Debian) nehmen nur GPL Software
auf, andere (z.B. SuSE) enthalten auch Kommerz-Ware,
die natuerlich i.d.R. nicht als Source dabei ist.
Schreibe ich ein Programm z.B. in C und verwende
dazu den gcc (GNU C-Compiler) und verteile das Binary
so brauche ich den Source nicht (!) mitzuliefern:
1. Ich habe das Programm geschrieben.
2. Die Teile des GNU-C-Compilers bzw. genauer
der GNU-Library, die sich in meinem Programm-
Binary befinden unterliegen nicht (!) der GPL
sondern der LGPL, die zu diesem Zweck
existiert.
Schreibe ich ein Programm in java und uebersetze es
mit dem Sun-Java-Compiler, warum sollte ich also
den Source-Code ausliefern muessen?
Die Klassen-Dateien liefere ich mit, aber von dort zum Source
ist es ein langer Weg.
Und fuer diese meine Software kann ich natuerlich
Lizenzgebuehren erheben.
Die Probleme mit Raubkopien und illegalen Kopien sind
die gleichen wie bei jeder Software.
Ein weiterer Punkt: Wer jemals mit einem groesseren
Software-Projekt gearbeitet hat, weiss genau:
Der Source ist ein Punkt, ohne das Wissen der
Mitarbeiter ist er wenig wert.
Bug fixing ist moeglich, Weiterentwicklung nahezu
unmoeglich oder nur mit aufwendigem Re-Engineering.
Seht euch dazu doch auch mal die Entwicklung der Firma Cygnus
an, die jetzt mit Red Hat zusammenarbeitet.
Cygnus bietet seit mind. 10 Jahren kommerziellen Support
und Weiterentwicklung fuer GNU-Produkte an ohne
in Konflikt mit der GPL zu kommen.
Nur durch Cygnus hat z.B. der GCC die Qualitaet, die er
heute hat.
Die Diskussion ueber die GPL ist nicht neu, auf der
GNU-Home-Page gibt es zusaetzliche Infos, die natuerlich

LICENSE GNU-Programmen mitgeliefert wird um ein
juristisches Dokument handelt, ist dieser Original-Text
natuerlich etwas schwer verdaulich. Das Resultat
einer fluechtigen Lektuere und blindem Vertrauen
auf Hoerensagen sieht man ja in diesem Thread.
Glaubt nicht blind alles was man hier schreibt, sondern
bildet euch selbst eine Meinung.
So jetzt reichts, liest vermutlich sowieso keiner, jedenfalls
bleibe ich vorerst in Ifo.

Zur Person: Ich bin selbst in ifo investiert und habe
seid 10 Jahren mit GNU Software zu tun.
Selten habe ich so einen Unsinn und ein grenzenloses
Halbwissen gefunden zum Theme GNU und GPL wie in diesem
Thread.
Und auf dieser Basis trefft Ihr Aktien-Kauf- und Verkaufs-
Entscheidungen? Naja, ist ja euer Geld.
Ein GNU/Linux-System verwendet einen Linux-Kernel.
Der Kernel unterliegt der GPL, will ich also den Kernel
aendern und das System dann verteilen, so muss ich
den Source zur Verfuegung stellen.
Auf dem System koennen GPL-Programme vorhanden sein,
aber auch andere. Die GPL gilt fuer die Bestandteile
unveraendert, aber nicht fuer das System insgesamt.
Manche Distributionen (Debian) nehmen nur GPL Software
auf, andere (z.B. SuSE) enthalten auch Kommerz-Ware,
die natuerlich i.d.R. nicht als Source dabei ist.
Schreibe ich ein Programm z.B. in C und verwende
dazu den gcc (GNU C-Compiler) und verteile das Binary
so brauche ich den Source nicht (!) mitzuliefern:
1. Ich habe das Programm geschrieben.
2. Die Teile des GNU-C-Compilers bzw. genauer
der GNU-Library, die sich in meinem Programm-
Binary befinden unterliegen nicht (!) der GPL
sondern der LGPL, die zu diesem Zweck
existiert.
Schreibe ich ein Programm in java und uebersetze es
mit dem Sun-Java-Compiler, warum sollte ich also
den Source-Code ausliefern muessen?
Die Klassen-Dateien liefere ich mit, aber von dort zum Source
ist es ein langer Weg.
Und fuer diese meine Software kann ich natuerlich
Lizenzgebuehren erheben.
Die Probleme mit Raubkopien und illegalen Kopien sind
die gleichen wie bei jeder Software.
Ein weiterer Punkt: Wer jemals mit einem groesseren
Software-Projekt gearbeitet hat, weiss genau:
Der Source ist ein Punkt, ohne das Wissen der
Mitarbeiter ist er wenig wert.
Bug fixing ist moeglich, Weiterentwicklung nahezu
unmoeglich oder nur mit aufwendigem Re-Engineering.
Seht euch dazu doch auch mal die Entwicklung der Firma Cygnus
an, die jetzt mit Red Hat zusammenarbeitet.
Cygnus bietet seit mind. 10 Jahren kommerziellen Support
und Weiterentwicklung fuer GNU-Produkte an ohne
in Konflikt mit der GPL zu kommen.
Nur durch Cygnus hat z.B. der GCC die Qualitaet, die er
heute hat.
Die Diskussion ueber die GPL ist nicht neu, auf der
GNU-Home-Page gibt es zusaetzliche Infos, die natuerlich
schwer zu beschaffen sind:

also ich habs gelesen!
um das was du geschrieben hast mal kurz zu fassen - drinbleiben!
hältst du es für warscheinlich das IFO noch weiter runtergeht?`
habe heute was gelesen das IFO bis 30€ konsolidieren soll.
als quelle war www.investorsplace.de angegeben. dort ist aber nur der verweiß zu einem
sauteuren faxabruf.
schreib mal was du oder auch die anderen dazu denken

JNT is systemsoftware for thin clients. It shall be used for e.g. hand held applications. In the moment it is not clear wether or not Infomatec is going to succeed in their afforts to establish this new type of systemsoftware in the highly competetive market of linux applications because of the strong opponent situation.
