No it doesn't mean he is not in agreement with walrath. Justice requires parties to have their day in court and the opportunity to be heard even on frivolous attempts to appeal. Just because he allows them time to submit briefs or legal memos doesn't mean he will read them....maybe his clerk will. He certainly doesn't want anyone accusing him of summarily denying them leave to appeal without due consideration. The lawyers do the paper pushing and he makes a ruling. The more the lawyers do , the less he has to. You guys read too much into every filing imho. You are just letting all the lawyers acquire the shares cheaply imho. Of the 35 lawyers I keep in contact with from my law school days (spread out all over the country) everyone tells me they have taken a position in this play.

I am amazed how some people can't grasp the size of the settlement. They base their rationale on a feeling, like how can a $.15 stock go to $24. Must be wrong, I would think only $2. Hello, how does the negotiating attorney place a fair value. Just a pie in the sky guess? How 'bout SWAG (scientific wild ass guess). Our legal team both boards have educated us and there is a formula. If we go to court 3X book value. A settlement, something a little less. So, say 2X book value. WAMU book value last Q they reported (June 2008) was $26B. Also, recall TPG made a capital infusion of $7-$8B in August 2008. 2X book value equals $52B. Take away debt and preferreds, leaves about $40B for common equity. 1.7B O/S equals $23.5/s. Now do you understand. It is not an opinion, just simple arithmetic based on what a good negotiating team would want. Since they hold the winning hand, they get what they ask for. Really pretty simple.
I see a settlement coming very soon. Meaning a month or less. I do give credence to the long weekend theory (Labor Day) but obviously the parties must be in agreement. The reason I say soon is based on Weil's willingness to back off and delay discovery. If the parties were far apart I think Weil would have a trail of complaints to THJMW regarding JPMC lack of response to discovery. Also, why has THJMW remained silent. Basically JPMC is in contempt of court. The only logical answer is that both parties are close and making progress towards settlement. If talks break down, then watch for a rash of filings from Weil against JPMC regarding discovery.
