Nortel hit by news of criminal probe

NEW YORK (CBS.MW) - Nortel Networks shares fell Tuesday after the company said the Royal Canadian Mounted Police`s informal probe of the company`s accounting has now become a criminal investigation.

The news is the latest blow to the networking company, which is also under investigation by U.S. federal prosecutors and by U.S. and Canadian securities regulators.
A few months ago, Nortel (NT: news, chart, profile) fired its chief executive after discovering a pattern of suspicious accounting and said it would restate financial results as far back as 2001.
The company said last week that on Aug 19 it expects to provide "estimated limited preliminary unaudited" results for first- and second-quarter 2004.
Official results for the first half of 2004 won`t be filed until the end of the third quarter, Nortel said. It also expects to report results for 2003 at that time and update investors on the impact of the financial restatements.
In a related matter, Nortel appointed a special committee to probe allegations raised in a July 12 letter from certain shareholders that company executives breached their fiduciary duties in the years 2000 to 2003. A complaint with similar allegations was filed July 30 in U.S. District Court for the Southern District of New York.
Nortel shares were recently trading down 1.8 percent at $3.36, on active volume of 15.5 million shares.
Morgan Stanley analyst Alkesh Shah said the RCMP`s criminal proceedings are a natural follow-on to the informal probe.
"We note that senior management associated with the accounting irregularities have already been separated from the company," he told clients in a note. "We believe the investigation ... is likely to take some time and we do not expect it to affect the company`s proposed timeline for releasing its revised financial statements."
Shah believes the stock`s current price discounts gross margins below 40 percent, while he is expecting them to be at least 40 percent if not more.
"We think the higher gross margin, coupled with some initial insight into the revised financials and outlining its [cost saving] measures, could provide an upside catalyst for the stock," he said.
In late June, Nortel said it`s failing to meet targets on expense controls and operating profit margins and indicated that further cost cuts are on tap.
In recent years, Nortel has slashed expenses and cut thousands of jobs amid the telecom industry`s worst slump. In June, the company agreed to sell most of its global manufacturing operations to Flextronics International.

Die Zahlen morgen werden ordentlich sein. Wenn dann noch (irgendwann einmal) die Unklarheiten mit der Bilanzierung aus den Vorjahren beseitigt ist, steht dem Weg gen Norden nichts mehr im Wege....
