Guarantors, and the Trustee. Unless otherwise noted, capitalized terms used but not defined
herein shall have the meaning given them in the Indenture.
Recent News
The German insolvency administrator, Dr. Gerloff, has submitted his final report to the
insolvency court. If Noteholders wish to receive a copy of the report Noteholders may request a
copy by emailing Gary Bush, Vice President, The Bank of New York Mellon at
gary.bush@bnymellon.com and also providing a copy of a brokerage, bank or other custodian
statement demonstrating that the requesting Noteholder is a current owner of the Notes.Dr. Gerloff’s report is in German. No English version has been provided to the Trustee.
The Trustee has been advised that the final report states that the insolvency administrator
has EUR 17.1MM on hand, but funds available for distribution to all creditors will only be
determined after court costs and remuneration of the insolvency administrator have been
conclusively determined. Currently, the insolvency administrator estimates that EUR 13.2 MM
may be made available for all creditors when the final closing of proceedings take placce.
The insolvency administrator cannot predict how long it will take the court to review the
final report, but estimates it may not occur until sometime in the second half of 2020. As such,
the Trustee does not know the timing and amount of a final distribution to Noteholders.
Direction to the Trustee
Section 6.8 of the Indenture provides that Noteholders holding a majority in principal
amount of outstanding Notes may direct the Trustee as to the time, method and place of
conducting any proceeding for any remedy available to the Trustee. The Noteholders’ ability to
direct the Trustee is subject to the requirements of Section 7.2(e) of the Indenture, which, among
other things, state that the Noteholders must provide the Trustee with satisfactory indemnity
against the costs, expenses and liabilities which might be incurred as a result of the Noteholders’
requests before the Trustee need follow the direction of the Noteholders.
Noteholders should not rely on the Trustee as their sole source of information. The
Trustee makes no recommendations and gives no investment, financial, tax or legal advice as to
the above matters or as to the Notes generally.

Bei 13,2 Mio€ und ca. 210€ Mio Forderung kommen ca. 6,2% rum und 3,9 Mio Euro lösen sich nochmal in "Luft" auf. Leider soll das Geld erst im zweiten Halbjahr kommen - ich bin gespannt.

Frage zu information
Hallo auch ich bin im Besitz dieser Anleihe. Ich habe ebenfalls den Bericht angefordert bin aber leider etwas überfordert damit. Ist das Verfahren jetzt schon abgeschlossen oder muss man nun irgendwo seine Ansprüche geltend machen? Es wäre super wenn ich etwas weitere Infos bekommen könnte.

Weiss denn jemand, ob die Anleihe danach automatisch ausgebucht wird. Das müsste doch der Insoverwalter über den Trustee in die Wege leiten?

Übrigens geht die SDK gegen den erneut sehr hohen Vergütungsantrag des Verwalters vor. Ebenso prüft man die Vergütung des Treuhänders.
Auf Intervention der SDK wurde bereits die Vergütung für die vorläufige Insolvenz um 2 mio. reduziert. Wer die Sache unterstützen möchte, denkt über eine Mitgliedschaft nach (bin selbst nur einfaches Mitglied und bekomme keine Provision oder ähnliches).

... zumindest bei meiner bis dato einzigen vollständig getilgten Insolvenzquote war das so. Die Abschlusszahlung ging aufs Konto, die Wertpapiere wurden bankseits ausgebucht und der insgesamt errechnete Gewinn wurde versteuert.
Solange aber nach Schlussauskehrung "noch minimaler Rest bleibt" passiert nach meiner bisherigen Erfahrung nichts.

Die Berliner Stadtbootflotte war wegen Corona sicher auch lange Zeit im Shutdown. Das deutet aber dezent an, dass nach der Intervention der SdK durchaus 6.- bis 8.- € mögllch sind.
In wie weit IV und Trustee das zum Anlass nehmen, die seit langem ausstehende Zahlung noch länger zurückzuhalten - wird sich zeigen ....

Irgendeine Idee wann es nun endlich zur Ausschüttung kommen wird? Die Trustee Meldung ist ja mittlerweile fast 6 Monate alt... irre dass das Insolvenzverfahren bereits seit über 10 Jahren läuft...
