BHP prepares for fresh battle against $6.6 bln Brazil dam lawsuit
LONDON, March 31 (Reuters) - Anglo-Australian mining giant BHP (BHP.AX) is preparing to battle a resurrected 5 billion pound ($6.6 billion) lawsuit in London's Court of Appeal next week, launched by around 200,000 Brazilians over a devastating dam failure in 2015.

The claim, one of the largest in English legal history, seeks to hold BHP to account for the disaster in English courts, emulating lawsuits brought in London against miner Vedanta and oil giant Shell (SHEL.L) by villagers over alleged pollution in Zambia and oil spills in the Niger delta respectively.

Iron ore may see structural shift on lack of new supply, decarbonisation: Russell
PERTH — Much of the iron ore debate focuses on the outlook for demand in China but bubbling in the background are two factors likely to cause a structural shift in the market for the steel raw material – the lack of new supply and decarbonisation.

What happens in China is the main driver of short- and medium-term iron ore prices, which isn’t surprising given that it buys almost two-thirds of all sea-borne volumes and produces about half of the world’s steel.

What receives less attention is the state of supply, and this is perhaps because it has been largely stable in recent years, and only really becomes a market issue when there is a significant disruption, such as cyclones in top producer Australia or coronavirus-related production and transport difficulties in number two shipper Brazil.

But dig a little deeper and it becomes clear that at best iron ore supply is likely to remain steady in coming years, with the major miners only investing enough to replace depleting mines and junior producers not aiming to add much more than relatively small volumes.

Vale-BHP JV Samarco says it has not yet reached agreement with creditors
SAO PAULO, March 30 (Reuters) - Brazilian miner Samarco Mineracao SA failed to reach an agreement with creditors on its restructuring plan after a new round of meetings, it said on Wednesday, ahead of an April 1 bondholders assembly.

The company, a joint venture between Vale SA and BHP Group PLC, said in a statement it presented bondholders with "significant improvements" to its restructuring proposal, but no deal had been reached.

Creditors of Samarco had suspended an assembly earlier this month after the company came up with the new restructuring proposal, offering an alternative to pay them with hybrid bonds that would distribute part of Samarco's cash flow.

Bondholders, that had rejected Samarco's previous proposal, agreed to reconvene on April 1 to vote on the offer. They could also push for an alternative plan, but Samarco said their proposal was inviable.

"The company demonstrated payment prospects and commitments to creditors in the short, medium and long term... (But) it was not possible to reach to date an agreement due to the inviability of some of the most recent bondholder proposals with the business plan of the company," Samarco said.

"The proposals presented by the funds put at risk the maintenance and the full resumption of Samarco's operations," it added.

Samarco said that it remains in contact with bondholders' advisors to reach a "viable agreement that meets the interests of all parties."

BHP eyes $10 bln Chilean investments, but only with 'legal certainty'
BHP Group Ltd said on Tuesday it will invest more than $10 billion in Chile to fuel growth in the world’s largest copper producing nation for the next 50 years, but only under certain regulatory and fiscal situations.

Chile, which supplies nearly a quarter of the world’s copper, recently elected a new leftist government, is redrafting its constitution and considering raising its mining royalty to fund expanded social programs. Several copper miners have paused investment decisions in the country while the political negotiations play out.

“We love Chile. We would like to stay here. We would like to grow in this country. But in order to do that, it will require fiscal stability, legal certainty and a clear pathway to permit,” Ragnar Udd, BHP’s president of minerals, Americas, told the CRU-CESCO World Copper Conference in Santiago.

BHP already operates Chile’s Escondida, the world’s largest copper mine.

Udd spoke at the conference not long after Marcela Hernando Pérez, the new Chilean mining minister, who said that Santiago does not plan to nationalize the country’s mining sector. Perez had left by the time Udd spoke.

Udd said that the investments from BHP would fund a new concentrator and leach processing facilities, new mining areas and projects to help reduce the company’s carbon emissions.

“I hope that I’ve convinced you today that under the right investment conditions, we can deliver copper to support the world of the future in a way that is sustainable and create social value for the communities and societies in which we operate,” Udd said. Nickel jumps, zinc climbs on worries over supplies, energy

By Eric Onstad LONDON, March 23 (Reuters) - Nickel prices jumped 15% to their upper limit and zinc and other industrial metals also climbed on Wednesday as disruptions from the Russia-Ukraine conflict and higher energy prices stoked concerns of shortages.

Metals prices extended gains after Russia said it would seek payment in roubles for gas sales from "unfriendly" countries, sending European gas prices soaring and fuelling worries about more smelter closures.

Benchmark nickel on the London Metal Exchange spiked by nearly $3,000 in the span of about 20 minutes and held the 15% gain at $32,380 a tonne by the time closing prices were set. The LME has decided, however, that no official or formal closing price would be recorded for nickel when it hits its price limit.

"The nickel market is still very much trying to find its feet," Geordie Wilkes, head of research at broker Sucden Financial, said. "You'd expect more volatility in the near term with low liquidity, low inventories, higher margins and uncertainty over the Ukraine conflict making this a very tricky trading environment."

Overall LME volumes were lower than usual as many investors stayed on the sidelines, traders said. But nickel volumes of over 3,500 lots were largely in line with other major metals, suggesting the market was starting to return to normal after two weeks of chaos.

The world's top nickel trading venue endured a record price surge on March 8, a six-day trading suspension, and then a restart hit by technical glitches after it launched price limits for the first time.
