Stans Energy Corp. comment on the withdrawal of the
license agreement with Kutisay Mining Ltd
Tazabek - Company Stans Energy Corp. July 5 issued a
statement about appearing in the media about the license
agreement number 3 of "Kutisay Mining".
Secretary of State of the State Agency for Geology and
Mineral Resources of the Government of KR on June 27
reported that the department has withdrawn the License
Agreement number 3 on June 15, 2012 in LLC Kutisay
Mining. Earlier, on June 26, the committee Jogorku Kenesh
to develop industries for handling MP Nurzhan Badykeevoy
of illegal extension of the license agreement with Kutisay
Mining Ltd recommend the agency to cancel the agreement.
According to deputies, the government in the face of the
agency shall issue a license without an auction.
In this regard, the Canadian company Stans Energy Corp.,
More than six years working in Kyrgyzstan through its
subsidiaries, Stans Energy KG LLC and LLC Kutisay Mining
reports that information on the withdrawal of the State
Agency for Geology and Mineral Resources Ltd have Kutisay
Mining license number 3 of June 15, 2012 is incorrect. In
this incident was an appropriate rebuttal.
The company is interested in why the committee considered
the issue of the license agreement, do not invite to their
meetings and not listening to the opinions of the
representatives or the management of subsidiaries in
Kyrgyzstan.
"License Agreement by its nature is a technical document
governing the relationship between the agency and Kutisay
Mining Ltd on the terms of the agreement included in the
subsoil in the field. The conclusion from the licensee of each
subsequent license agreement is held by the Commission as
required by the agency and the Law "On Subsoil" does not
put up for auction. Therefore, the statement of Mrs.
Badykeevoy in this part, of course, is contrary to applicable
law on subsoil KR ", - said in a statement.
Stans Energy Corp. specifies that the extension to Kutisay
Mining Ltd license number 3 on June 15, 2012 conducted by
the Government is not the CD, and the Commission on
Licensing Agency, which is competent to address this issue.
"At the same time making this decision was preceded by a
three-month negotiations, which resulted in our subsidiary
company pledged to consider the possibility of donation
Kyrgyzskoy Republic of the equity stake in the LLC Kutisay
Mining. In this regard, at the present time we have
conducted an economic analysis to determine the particular
part of the transferred shares, "- said the company.
According to Stans Energy Corp., The company has not
received a license to mine Kutessay II in the state. In
December 2009, Stans Energy KG LLC in Bishkek
purchased at public auction at the Stock Exchange of
Kutisay Mining (far LLC Kutisay Mining), which owned the
license for the deposit Kutessay II. On sale were exposed 19
million ordinary shares of Kutisay Mining at a starting price
of 1 som per share. The company offered 1.98 per share and
the catfish was the successful bidder. Thus, Stans Energy
Corp. Kutisay Mining bought the company with a license to
mine Kutesay II for 37 million 620 thousand soms.
The following year 2010, according to the requirements of
the Tax Code of KR, Kutisay Mining Ltd has paid a bonus to
the State a royalty of $ 19 million 86 thousand 467 som.
The Canadian company Stans Energy Corp. over the past
six years invested in the mining industry in Kyrgyzstan only
on exploration of more than $ 5 million "This is absolutely
baseless accusations against us that we came to a Kyrgyz
market in 2009 with speculative purposes. In addition to
investments in exploration for the purposes of development
of the field Kutessay II in 2011, we acquired the rare-earth
part of the production at OJSC "Kirghiz Chemical and
Metallurgical Works" for $ 5 million 500 thousand in 2010-
2011, the cost of pre-, exploration and other work ( design,
electronic counting inventory, technological research, and
other ores) in the fields of Kutessay II and Kalesay, as well
as the reconstruction of the purchased number of shops
number 2 and 3 accounted for more than $ 3 million 500
thousand ", - said the company.
Stans Energy Corp. refutes the allegations, prosecutors
alleged that the CD in June 2011 revealed irregularities in
the activities of subsidiaries. Inspection of the Ministry of
Natural Resources CD, a division of Emergency (7 OMGSV
GSS) and other organizations, conducted by order of the
Prosecutor General of KR was established insolvency of the
charges in the complaint of the applicant (company «Central
Asia Minerals»), the former owner of a license to mine
Kutessay II, the company said, adding that test results have
not been submitted to it.
In addition, the State Agency on Geology was established
that the exploration activities carried out under the approved
project is not one, but at least four major contractors
(geophysicists, geologists, drillers and analysts) from
Kyrgyzstan, and they all have the necessary licenses or
certificates to carry out such works.
Regarding the claim that Kutessay II ranks 6th in the world
reserves of rare earth metals, the company did not pay
attention to the fact that in Russia alone has more than 6
fields with large reserves, not to mention China and other
countries. In fact, Kutessay II in terms of stocks is about 23
in the world. "However, there is the more important question:
what does the question of reserves is the question of
revoking the license obtained by us in accordance with the
law?" - Asks the company.
In addition, the company informs the public authorities and
the public Kyrgyzskoy Republic, at the invitation of Stans
Energy Corp. MP Nurzhan Badykeeva this spring attended a
public hearing on the project in the village Aktyuz and after
reviewing the project promised the villagers to give full
support to the project company.
