Rambus up after judge stays final phase in Hynix trial
CHARLOTTE, N.C. (Dow Jones/AP) -- Shares of Rambus Inc. surged Wednesday, after a judge in its patent-infringement case against South Korea's Hynix Semiconductor Corp. stayed the final phase of the six-year long court battle.
Stock of the Los Altos, Calif.-based memory-technology company climbed $2.12, or 19 percent, to $13.33 in early trading on the Nasdaq Stock Market.
Wednesday's strongest level, on heavy volume, was $13.48. On a 52-week basis, there was a high of $46.99 on April 19 and a low of $10.22 last Sept. 2.
On Tuesday, U.S. District Judge Ronald Whyte in San Jose, Calif., said the final trial in the patent-infringement case will be delayed until Feb. 2, 2007, or until the U.S. Federal Trade Commission levies a penalty against Rambus in a separate antitrust case.
Rambus was found guilty by the FTC of monopolistic tactics. According to Whyte, the FTC remedy will have industry-wide implications and could establish a reasonable rate for royalties for Rambus' patent-protected products.
Hamed Khorsand, an analyst at BWS Financial, which rates Rambus a ``buy,'' said that going into Tuesday's ruling, many had expected a negative outcome and sold off shares of Rambus as a result. He said the stay of the final phase of the trial shows that either way Hynix will have to pay royalty rates to Rambus. That's driving the stock higher Wednesday.
Ever-volatile Rambus has seen its stock decline more than 70 percent since setting the five-year high of $46.99 in April.
The company has been embroiled in a series of lawsuits against some of the largest memory makers for years, claiming patent infringement.

Das Verfahren wird bis zum 2. Februar eingestellt oder kann auf Weisung der Federal Trade Commission (FTC) wieder aufgenommen werden. Das soll Hynix 90 Tage Zeit geben, um sich mit der FTC auf eine Lösung zu einigen.
Das Handelsvolumen der Rambus-Aktie war heute während der Kursgewinne deutlich höher als gewöhnlich: 15,76 Millionen Anteile wurden in den ersten Stunden gehandelt.

Rambus Shares Rise on Ruling

A judge in California has delayed the final stage of a six-year patent dispute between Rambus and Hynix Semiconductor, leading to speculation that the companies will settle and setting off an 18 percent gain in Rambus’s share price.
Judge Ronald M. Whyte of United States District Court in San Jose, Calif., said on Tuesday that the third trial in the Hynix case, originally set to start next month, would not start until at least February. That would be after the Federal Trade Commission issues a penalty against Rambus in a separate antitrust lawsuit.
Investors may be betting that the delay will prompt the two companies to settle, said Daniel Amir, an analyst at W. R. Hambrecht & Company.
The F.T.C. penalty will result from a ruling the agency made this month that Rambus engaged in “deceptive conduct” to control patents for high-speed computer memory chips.
According to a statement from Rambus, Judge Whyte indicated that the F.T.C. penalty could help establish royalty rates for the computer chips at the heart of the case and lead to a settlement. Shares of Rambus, which is based in Los Altos, Calif., rose $1.98, to $13.19.
