bemerkenswert finde ich den trading halt weil hier das mgmt seit langem erstmals wieder interessiert an kursstützender aktivität erscheint.
und überhaupt das timing, KE regelrecht reingequetscht in eine kurszacke. der fachmann staunt und der laie wundert sich wie sowas geht.
und dann noch das: erstmalig unforseen events mit ansage...quasi 'möhrenmodus off'

Lynas confirms Malaysian Court win

Lynas Corporation Ltd has confirmed that the Kuantan High Court has dismissed the latest application from by the Save Malaysia Stop Lynas group for an interim stay in respect of the Temporary Operating Licence (TOL).
In a statement to the Australian Securities Exchange, Lynas said the judgment clears the way for it to commence production at its controversial rare earths plant by the end of the year.
"The recent legal proceedings in the Kuantan High Court have not detracted from the ongoing operational preparation of the LAMP for production," Lynas said.
"Lynas is committed to its objective of successfully transitioning to a rare earths producer and trusted supplier, with first feed to kiln expected by calendar year end, followed by a ramp-up period of three to four months until first commercial sale of REO product and subsequent cash generation."
Yesterday, Lynas announced the Save Malaysia Stop Lynas group has again launched legal action against the miner's temporary operating licence (TOL).
"Lynas became aware, initially through statements made on the internet by the Save Malaysia Stop Lynas group, that there is a proposed in-chambers application to the Kuantan High Court today regarding a further application for an interim stay in respect of the temporary operating licence," the company said.
"Lynas believes that this appears to be a repeat of the application that was dismissed on 8 November 2012."
In the wake of the Kuantan Court's ruling, Lynas said it could not unconditionally rule out another challenge from the applicants, but noted the court judgment was very clear in its finding in favour of Lynas and that there was no injunction or stay preventing Lynas from carrying out its operations at the LAMP.

Hier ist so eine verzweifelte Stimmung, dass man richtig bullish wird.
Oft kommte es anders, wenn alle in dieselbe Röhre pusten.
Wer sich einen kurzen Überblick über die Entwicklung von Lynas machen will, sollte sich z.B. alle Präsentationen anschauen, die auf der Firmenhomepage abrufbar sind. Zwei Stunden Arbeit und man weiß, was die Firma bisher geleistet hat. Es gibt Schmerzen, dann kommt das Geld. Lynas hat ist auf dem Weg zum Global Supplier, und letztlich wird das seinen Weg gehen.
Übrigens, wer meint, aus 2 Milliarden Aktien könnte man nicht auf einen Schlag 200 Mio machen, hat nicht viel Erfahrung an der Börse.
Nur meine Meinung.
Bin dann mal weg morgen, es gibt ja noch andere Hobbies!

market yesterday and advises that the Kuantan High Court has dismissed the application by the
Save Malaysia Stop Lynas group for an interim stay in respect of the Temporary Operating
Licence.
Lynas has become aware that the applicants have appealed to the Malaysian Court of Appeal on
the same issue. It is possible that the applicants may also make further applications on the same
basis. However, we note that:

there remains no injunction or stay preventing Lynas from carrying out its operations at the
LAMP; and
Lynas (or the Government of Malaysia) have, on several occasions in the past, successfully
defended proceedings seeking injunctions, stay orders or similar orders including: the
Kuantan High Court decisions in November 2012; a decision by the Malaysian Court of
Appeal in September 2012; and a decision by the Kuala Lumpur High Court in April 2012;
The recent legal proceedings in the Kuantan High Court have not detracted from the ongoing
operational preparation of the LAMP for production. Lynas is committed to its objective of
successfully transitioning to a rare earths producer and trusted supplier, with first feed to kiln
expected by calendar year end, followed by a ramp-up period of 3-4 months until first commercial

Institutional Placement and SPP
Following the successful completion of the Institutional Placement and SPP, Lynas anticipates
having required working capital through to positive cash flow, necessary funds to meet capital
expenditure requirements and a significant cash buffer to allow for unforeseen events.
Mount Kellett has approached Lynas to discuss whether the capital raising has triggered an
adjustment mechanism under the Convertible Bond Deed Poll released to the market on 24
January 2012. As Lynas advised the market on 19 October 2012 the initial reset provisions of the
Convertible Bond Deed Poll no longer apply in relation to the obligation to obtain a Temporary
Operating Licence. As also advised on that date (and the date of issue of the Convertible Bonds)
the terms do include 'customary anti-dilution' adjustment provisions. The Institutional Placement
and SPP have not yet completed and therefore no determination can be reached on what
adjustment, if any, may be made.
