Lynas threatens to sue 45 NGOs

Lynas Corporation Ltd has sent a letter of demand to 45 NGOs including the Centre for Policy Initiatives for endorsing an open letter by activist group Save Malaysia Stop Lynas (SMSL) and which we published in this website on March 21.
Lynas through its solicitors Jeff Leong, Poon & Wong sent the letter to four SMSL committee members as well as the NGO endorsees, which besides CPI include: The Kuala Lumpur Selangor Chinese Assembly Hall (KLSCAH), Suaram, All Women’s Action Society (Awam), Women Aid Organization (WAO), Tenaganita, Centre for Independent Journalism (CIJ) as well as consumer, environmental and cultural non-governmental organisations.
The corporation’s lawyers have alleged that SMSL and the NGOs have made “false, destructive, and defamatory statements against Lynas” by imploring Prime Minister Najib Razak to stop any shipment of rare earth ore concentrate into Malaysia.
The Lynas lawyers are construing “the plain meaning” of the open letter to the PM, calling for a suspension of the operating licence issued to the Australian corporation, as carrying the connation that:
(a) Lynas knowingly and intentionally seeks to cause danger to the health and lives of Malaysians by building, running, and operating the LAMP (Lynas Advanced Materials Plant), and deliberately places Malaysians in harm’s way through irresponsible pollution of the ground and the air through the discharge of waste water and toxic gas produced by its refining plant,
(b) Lynas is negligent and attempts to deceive the Malaysian public, this being done hand in hand with the IAEA, by claiming that the LAMP meets international standards though it fails to do so since amongst other factors its plant does not provide for a zero waste water return policy,
(c) Lynas is negligent and attempts to deceive the Malaysian public by refusing to disclose structural defects and faults which have arisen with the LAMP, and which pose immediate danger of radioactive leakage,
(d) Lynas has deliberately and consciously deceived its investors as to the reasons for delay as to start of operations for LAMP,
(e) Lynas is not a company that cares about the environment, and through the building and running of the LAMP, this would propagate a hazardous operation which no ecologically minded company should or would wish to partner.
Lynas claims that the allegations set out above are “completely untrue and/or are factually inaccurate” and that the SMSL public appeal as a whole is highly defamatory.
Declaring that Lynas cannot allow to the “serious, offensive and damaging libel” to pass unchallenged, the lawyers have set forth their rebuttal on the key matters (see snapshots below of the 23 points as contained in their letter of demand).
The Lynas lawyers are demanding that the SMSL public statement be completely removed from websites, blogs, publications, forums and other media spaces that have earlier carried the open letter.
The lawyers also require that SMSL and the NGOs implicated publish the information (contained in the 23 points outlined by its lawyers to correct the “factual inaccuracies”) within seven days upon receipt of the Lynas demand.
Lynas and its lawyers want an apology to be issued in “prominent lettering” in terms to be approved by them, in addition to a guarantee that the activists and NGOs refrain from publishing any further statements similar to the appeal to the prime minister last month.

SMSL & Malaysian NGOs Statement against LYNAS

Dear Mr Prime Minister,
Save Malaysia Stop Lynas (SMSL) together with the undersigned civil society organisations of Malaysia, would like to strongly implore you as the Malaysian Prime Minister and to immediately suspend the licence issued to Lynas and to stop any shipment of rare earth ore concentrate into Malaysia.
The Lynas Advanced Materials Plant (LAMP) in Gebeng is the world’s largest rare earth refinery project owned by speculators with no real experience in industrial processing or rare earth. Rare earth refining is linked with serious pollution and health risks. The plant is located in a densely populated area unlike most industrial estates. The closest housing estate is a mere 2km from the plant and within a 30km inland radius live 700,000 people.
The LAMP is the world’s biggest rare earth refinery owned by a lone-project speculative company with no previous experience. Its design is based on the Chinese technology. Yet approval and an operating license were given without due consideration into the full extent of its impact which will only be uncovered through a detailed EIA.
Lynas would not be allowed to construct a plant similar to the LAMP with its associated waste management plan anywhere in Australia. Currently, several other rare earth proposals are being considered in Australia. All of them are committed to adopting a zero-waste water discharge policy and having their radioactive waste returned to the mine site for proper disposal. Clearly, Lynas has not been transparent in claiming that its LAMP project is of international standard.
Specifically we would like to draw your attention to the following facts:
Serious construction problems of the LAMP - 22 concrete tanks in the processing area was defective and will result in corrosive and radioactive materials leaking onto the plant floor and into the ground eventually. These tanks were not moisture-proof, which is a standard engineering practice for this kind of plant. It is especially essential in a damp swampy environment. We have and continue to receive confidential accounts of failed electrical wiring and installation, failed hydro tests where major tanks with structural cracks and leaks were detected, broken underground water pipes that need to be redone and so forth. A large section of the plant has sunk. Many of these defects could not be easily fixed or safely repaired. Lynas is believed to have grossed over the problem and have summarily covered up the defects. The full extent of the construction defects and design problems can only be uncovered by a thorough independent engineering audit.
The absence of a scientific consensus on what is a safe dose of radiation exposure– There are increasing medical and scientific evidence that prolonged exposure to low-dose radiation is harmful. Lynas has conveniently ignored this risk and the IAEA had grossed over this point without any substantiated reason. The responsible approach under this circumstance is to adopt the precautionary principle of no safe dose and to impose a zero discharge strategy to minimize risks.
Lynas will not be able to return the waste to Australia or to a third country. The Western Australian Government has stated TWICE publicly declared it will not accept any of Lynas’ waste from Malaysia – refer to the attached scanned copy of the official statement from the Hansard. At the end of 20 years, Lynas will be dumping 10 million tonnes (wet weight) of solid radioactive waste that will be hazardous for longer than the lifespan of planet earth. This is NOT in Malaysia’s national interest.
No safe permanent site for the storage of radioactive waste. The failure of the AELB in managing the radioactive waste from the Asian Rare Earth (ARE) plant in Bukit Merah casts serious doubt that Malaysia has the capacity to safely manage such hazardous waste. Lynas’ solid waste contains many other hazardous substances and heavy metals which should be carefully managed and disposed of. They should NOT be allowed to be commercialized either as gypsum or as a fertiliser.
No Detailed Environmental Impact Assessment (EIA) - Serious water contamination by the discharging of 500 tonnes of contaminated water every hour into the important mangrove habitat of the Balok River. Air pollution caused by Lynas’ proposed “air dispersion” technique which is a cheap and unsafe way to disperse the polluting gases into the atmosphere. The refinery plant is located on top of a peatland when cleared is prone to floods and fires. The huge amount of fuel, concentrated acids and other combustible substances which will be kept in the LAMP premises will become fire hazards.
Need for a Socio-economic impact study (SIA). - The strong and persistent protest actions against the Lynas project is a clear indication of the threats the project poses to local communities. Our fears are due to the potential loss of a safe environment to live in; potential loss of incomes, and decline in the tourism industry as well as the property market. Furthermore outward migration of families from well-educated and high socio-economic background from Kuantan will lead to a further brain-drain of people who have invested for over a generation and contributed much to the prosperity and development of the town and the state.
Lynas’ unrealistic timeline & incompetence. Lynas has promoted an unrealistically early production date for September of 2011 to be the first outside of China to supply rare earth oxides. In truth Lynas has conveniently deceived its investors by attributing the delay to the protests and the licensing delay. The AELB has persistently assisted Lynas by making contradictory public statements both declaring the granting of the licence for the benefit of Lynas just to deny it in another time to appease the angry Malaysian public. Had Lynas admitted to its own failure, its stock would have slipped to a dangerously low value potentially sending Lynas to bankruptcy.
Economic activities spin off from the LAMP will be limited - Socially responsible and ecologically conscious corporations and investors will not want to associate its operations with or next to a controversial hazardous plant like the LAMP. Decent companies with a clean and green reputation will not risk locating their plants close to the LAMP nor source their supply from Lynas.
Malaysia risks gaining a bad reputation as a haven for toxic projects. The massive amount of waste, in particular contaminated air (90,000 cubic metre an hour) and water (500 tonnes an hour), which will be discharged into the natural environment has the potential to contaminate a wider area of coverage thereby posing potential threat to lives in the neighbouring countries. By accepting and facilitating the Lynas project. Malaysia has essentially opened its door to polluting industry escaping tighter scrutiny and carbon tax from industrialised developed countries forced to cut down their carbon pollution from the threat of climate change.
We therefore strongly appeal to you to immediately cancel all LYNAS operations based on the clearly serious life threatening consequences it has on the lives and environment of all peoples in Malaysia.

Mir geht es momentan einzig um das spannende hin und hergeziere zwischen Lynas und den anderen Beteiligten, wer denn nun an den Verzögerungen Schuld ist.
Da behauptet eine Lynas, dass alles fertig sei und man nur auf die Lizenz warte ... und bei der AELB wartet man zur Erteilung der Lizenz nur auf die Absegnung des "third party acessors" DURCH LYNAS. Ja wo hakt´s denn hier wirklich?

Von Denkverboten ist bei mir nie die Rede gewesen, eher klar das Gegenteil ...
... und das Recht zu denken, selbst zu recherchieren und die Korrektur von Fehlaussagen - von Leuten, die meinen "nur weil ein FaxenClown sich einen schlecht recherchierten Basher-Artikel zur Brust nimmt - kann man (stellenweise ungerechtfertigt, aber dafür doppelt so wehement) nochmal nachtreten" - nehme ich mir dann mal raus.
Wenn´s dir nicht schmeckt - bitte. Nehme ich zur Kenntnis, werde daran aber nichts ändern.
... und mit Altruismus habe ich genauso wenig am Hut. Ich bin ein User/Investor - genau wie du (nur - noch - nicht bei Lynas). Und bevor ich wieder in Lynas einsteige, sollen sie erstmal zeigen, dass sie ihre großspurigen Versprechen einhalten.
Genau das ist nämlich das Problem hier, wie ich mehrmals angedeutet habe. Man ist voller blinder Naivität nach Malaysia gegangen und hat der Bevölkerung schön "von oben herab" ein - mit anderen chemischen Anlagen verglichen "nicht viel gefährlicheres" - Werk vor die Nase gesetzt. Den Widerstand haben viele hier immer wieder verniedlicht und lächerlich gemacht ... aufgehalten (im Sinne von Verzögerung) wurde Lynas trotzdem - Logik hin oder her!
Warum wartest denn du schon seit Jahren? - Oder besser formuliert: Warum die Extrarunde Vorschußlorbeeren und damit den Schnitt bei Gewinn/Zeit versauen, während der Start mehrmals um insgesamt mehr als 6 Monate verschoben wird?
Kommt Zeit, kommt Gelegenheit ... zum Einstieg, zum Shorten oder wofür auch immer.
... und das mit der "Ernte ihres Invests" wird auch nicht sofort kommen.
Nach dem ersten Hype, kommt nochmal Talfahrt, bis sich alle beruhigt haben und Zahlen auf dem Tisch liegen. Dann werden die Analysten (einige durch die ganzen Verzögerungen und die vollmundigen Prognosen von Lynas leicht angenervt) ihre Messlatte anlegen - und Lynas darf dann springen.
... und mir ist relativ klar, was Lynas bisher proklamiert hat und woran Lynas gemessen werden wird. Das wird noch lustig werden ...

... und das Recht zu denken, selbst zu recherchieren und die Korrektur von Fehlaussagen - von Leuten, die meinen "nur weil ein FaxenClown sich einen schlecht recherchierten Basher-Artikel zur Brust nimmt - kann man (stellenweise ungerechtfertigt, aber dafür doppelt so wehement) nochmal nachtreten" - nehme ich mir dann mal raus.

... und mit Altruismus habe ich genauso wenig am Hut. Ich bin ein User/Investor - genau wie du (nur - noch - nicht bei Lynas). Und bevor ich wieder in Lynas einsteige, sollen sie erstmal zeigen, dass sie ihre großspurigen Versprechen einhalten.
Genau das ist nämlich das Problem hier, wie ich mehrmals angedeutet habe. Man ist voller blinder Naivität nach Malaysia gegangen und hat der Bevölkerung schön "von oben herab" ein - mit anderen chemischen Anlagen verglichen "nicht viel gefährlicheres" - Werk vor die Nase gesetzt. Den Widerstand haben viele hier immer wieder verniedlicht und lächerlich gemacht ... aufgehalten (im Sinne von Verzögerung) wurde Lynas trotzdem - Logik hin oder her!
Warum wartest denn du schon seit Jahren? - Oder besser formuliert: Warum die Extrarunde Vorschußlorbeeren und damit den Schnitt bei Gewinn/Zeit versauen, während der Start mehrmals um insgesamt mehr als 6 Monate verschoben wird?
Kommt Zeit, kommt Gelegenheit ... zum Einstieg, zum Shorten oder wofür auch immer.
... und das mit der "Ernte ihres Invests" wird auch nicht sofort kommen.
Nach dem ersten Hype, kommt nochmal Talfahrt, bis sich alle beruhigt haben und Zahlen auf dem Tisch liegen. Dann werden die Analysten (einige durch die ganzen Verzögerungen und die vollmundigen Prognosen von Lynas leicht angenervt) ihre Messlatte anlegen - und Lynas darf dann springen.
... und mir ist relativ klar, was Lynas bisher proklamiert hat und woran Lynas gemessen werden wird. Das wird noch lustig werden ...

Bei dieser Aktie sollte man etwas mehr Geduld aufbringen. Denn die Zukunftsaussichten sind enorm und auch di REE-Preise werden wieder ansteigen, wenn erst einmal die Wirtschaften in Amerika/China und weiteren aufstrebenden Ländern ins Laufen kommt.
Und m. E. kann sich Malaysia gar nicht leisten, die Produktion zu verhindern; das hätte einen starken Einfluss auf alle Auslandsinvestitionen in das Land.

We have also asked for scientific facts beyond the emotional and political rhetoric fanned by some non-governmental organisations and opposition political parties. It has been non forthcoming.
Instead there have been rumours and distorted facts to politicise the situation.
But as long as the waste from the Lynas plant is not disposed outside the country, the MCA will continue to object.
MCA will also strongly oppose any steps to issue a licence to Lynas if the plant cannot give a guarantee that the waste will be taken out of the country.
MCA will not compromise on this matter. The party will not deviate from its stand to listen to the voices from the ground.
It should be noted that the PAS MP for Hulu Langat, Dr Che Rosli Che Mat, who is a qualified nuclear scientist, has consistently said the Lynas rare earth plant would NOT be harmful.
The government has proposed the setting up of a Parliamentary Select Committee to probe on the safety of the Lynas plant – which the DAP had demanded on Feb 26 via its vice-chairman Dr Tan Seng Giaw.
But when the government announced its formation, DAP secretary-general Lim Guan Eng called for a boycott of the PSC on Lynas on March 19.
This flip flop attitude – in less than a month – reflect the political opportunistic nature of the DAP and its allies in Pakatan Rakyat.
Refusing to recognize potentially truthful scientific evidence and data, he chose to stay out for purely political expediency.
The Lynas issue has understandably being an issue of major concern to Malaysians, not just those who stay in Gebeng but surrounding areas in Pahang.
The MCA recognizes the voices of Malaysians who have put on record their objection to the Lynas plant.
The objection has also come from Pahang MCA leaders and grassroots members.
THE MCA HAS SPOKEN TO A WIDE RANGE OF ENVIRONMENT GROUPS WHO HAVE ALSO SHARED THEIR CONCERNS WITH US.
IT IS CLEAR THAT THE MAJORITY OF THE PEOPLE ARE AGAINST THE LYNAS PROJECT. IT IS NOT A QUESTION OF WHETHER IT IS SAFE OR NOT SAFE. IT IS SIMPLY A CASE OF THE MAJORITY OF MALAYSIANS ARE AGAINST LYNAS.
AS A RESPONSIVE AND SENSITIVE GOVERNMENT, WHO RESPECT THE VIEWS OF THE PEOPLE, THE MCA URGES THE FEDERAL GOVERNMENT TO CANCEL THE PROJECT.

Aber Sie sind trotzdem dagegen, weil die Mehrheit der Bevölkerung dagegen ist ((MCA ist eine Partei in Malaysia -> Stimmenfang?). Am Ende wird auch nochmal erwähnt welche Nachteile ein Abbruch des Projekts hätte.
Insgesamt find beide links positiv.
