SEC Charges 38 Defendants in Multi-Million Dollar Stock Loan Scams
Stock Loan Traders Paid Phony Finder Fees and Received Kickbacks in Schemes Netting More Than $12 Million in Unlawful Profits
FOR IMMEDIATE RELEASE

Washington, D.C., Sept. 20, 2007 - The Securities and Exchange Commission today charged 38 defendants in a series of fraudulent schemes involving phony finder fees and illegal kickbacks in the "stock loan" industry. The defendants include 17 current and former "stock loan" traders employed at several major Wall Street brokerage firms, including Morgan Stanley, Van der Moolen (VDM), Janney Montgomery, A.G. Edwards, Oppenheimer, and Nomura Securities. These traders conspired in various schemes with 21 purported stock loan "finders" to skim profits on stock loan transactions. The defendants pocketed more than $12 million from their unlawful schemes over a period of nearly a decade.

In two separate complaints filed in federal court in Brooklyn, N.Y., the SEC alleges that from 1998 until June 2006, the stock loan traders named as defendants routinely defrauded the brokerage firms that employed them and others by engaging in collusive loan transactions and causing the firms to pay sham finder fees to companies controlled by the traders themselves or by their friends and relatives. Acting as fronts for the traders, these companies received hefty finder fees on several thousand stock loan transactions even though they did not provide any legitimate finding services and, in many cases, were simply shell companies that were not even involved in the stock loan business. These phony finders included a mailman, a perfume salesman, a pharmacist and a dental receptionist. The defendants shared in the sham finder fees through secret kickback arrangements. In some cases, defendants met monthly at New York City bars and restaurants to exchange thousands of dollars in cash, often wrapped in newspapers or stuffed into envelopes.

Linda C. Thomsen, Director of the Commission's Division of Enforcement, said, "The defendants in these cases devised a host of brazen schemes to enrich themselves and others at the expense of firms engaged in securities lending transactions. The Commission will respond forcefully to misconduct in the securities industry, whether it occurs on Wall Street or Main Street and whether it is committed by individuals or large firms."

David Rosenfeld, Associate Director of the New York Regional Office, added, "As the breadth of today's action demonstrates, fraud was rampant in certain segments of the securities lending industry. Securities professionals who engage in collusion, cash kickback payments and outright theft undermine the integrity of our markets and will be confronted with aggressive enforcement action."

Complaint Alleging Schemes by Morgan Stanley Traders
In one of the complaints filed today, SEC v. Darin DeMizio, et al., the Commission alleges that over the course of several years, two stock loan traders employed by Morgan Stanley — Darin DeMizio and Peter Sherlock — and three other individuals, including relatives of the two traders, skimmed millions of dollars in stock lending profits from Morgan Stanley and another brokerage firm through illegal kickback schemes with a stock loan finder named Anthony Lupo. From July 2000 through June 2006, Lupo collected more than $4 million in finder fees as a result of these schemes and paid more than $1 million in undisclosed kickbacks. Pursuant to the scheme, Darin DeMizio and Sherlock caused Morgan Stanley to enter into unnecessary loan transactions at inferior interest rates for the purpose of artificially generating finder fees for Lupo. In exchange, Lupo paid kickbacks directly to Sherlock in cash and paid nearly $600,000 to shell companies controlled by Darin DeMizio's brother, Craig DeMizio, and Sherlock's brother-in-law, Donato Tramontozzi, a full-time pharmacist.

In a second and related scheme, Joseph Miller, a finder and former stock loan trader at Morgan Stanley, paid undisclosed cash kickbacks to a stock loan trader at a division of The PNC Financial Services Group Inc. (PNC) in exchange for receiving PNC stock loan orders from the trader. Lupo also participated and shared in the profits from the scheme. From January 2002 to June 2004, Lupo and Miller split more than $1.2 million in finder fees generated by PNC orders. Miller ended his arrangement with Lupo in May 2003, but Miller continued the kickback scheme with the PNC trader on his own until January 2005.

The Complaint Alleging Multiple Interrelated Schemes
In the second complaint filed today, SEC v. Joseph Simone, et al., the Commission alleges that 21 individuals, including 15 securities industry professionals, and seven entities involved in the stock loan business, engaged in widespread fraudulent conduct by using various schemes to skim stock lending profits from several brokerage firms. In these schemes, stock loan traders routinely defrauded their firms by causing the firms to pay finder fees to entities that did not perform any services at all on the relevant loans and, in most cases, were simply shell companies controlled by traders or their relatives. Where the traders were unaffiliated with the finders, the finders paid undisclosed cash kickbacks to the traders. From 1999 to 2005, the finders named as defendants received more than $8 million in sham finder fees. The named traders either arranged or facilitated the payment of these sham fees. Some of the traders also paid undisclosed cash kickbacks out of their illegal profits to other traders that facilitated those loan transactions. This complaint specifically alleges as follows.

While Joseph Simone was co-head of the stock loan trading desk at VDM, he engaged in several schemes to defraud VDM using Island Capital Management, Inc., a shell company that he controlled. Simone caused VDM to pay several million dollars in sham finder fees to Island. The following traders also colluded with Simone to increase Simone's illegal profits through circular loan transactions known as "ring" and "run-through" deals: Joseph Lando, the head of sales for Janney's stock loan desk; Joseph Caracciolo at National Investor Services Corp.; Alfred Varricchio at A.G. Edwards, and Anthony Pianelli at Weiss, Peck & Greer, LLC. Simone paid monthly cash kickbacks to these traders out of the sham finder fees paid to Island. Simone himself made approximately $3.6 million.

Brian Fabrizzi, the other co-head of VDM's stock loan trading desk, also defrauded VDM through the payment of sham finder fees from which he benefited. Fabrizzi conspired with Anthony Carannante, a finder who did business as A&C Management, and Donald Sorrentino, a trader at Oppenheimer. Fabrizzi and Sorrentino colluded to arrange "run-through" loans between VDM and Oppenheimer that enabled Fabrizzi to cause VDM to pay sham finder fees to A&C. Carannante kept a portion of the fees and funneled the rest back to Fabrizzi, who paid monthly cash kickbacks to Sorrentino.

Rochelle Roman and Shaun Sarnicola, two traders at Kellner Dileo & Co., conspired with Carannante and one of his associates, Steven Daronzio, to cause Kellner to pay sham finder fees to A&C. Carannante and Daronzio kept a portion of the sham fees, and Carannante paid the balance in cash kickbacks to Roman and Sarnicola.

Roman also defrauded Kellner by causing it to pay sham finder fees to AJT Ltd. and AJGT Ltd., two finder firms run by relatives of Joseph Lando: Anthony Tanico and Andrea Lando-Tanico, who is Lando's sister and Tanico's wife. Anthony Tanico paid Roman monthly cash kickbacks and kept the balance of the sham finder fees for himself and his wife. Joseph Lando also caused Janney to pay sham fees to AJT and AJGT.

Michael McCormack, a trader at A.G. Edwards, schemed with his wife, Donna Centola, Joseph Lando and Roman to defraud A.G. Edwards through sham finder fees paid to DMAC Services, Inc., a shell company owned by Centola. McCormack arranged for Joseph Lando and Roman to have Janney and Kellner borrow stock from A.G. Edwards at low rates and then lend the stock to other firms specified by McCormack at higher rates. DMAC's sham finder fees were paid out of these artificial profits.

Andrew Caccioppoli, a trader who supervised Janney's stock loan desk, schemed with his sister, Donna Macli, and her husband, Thomas Macli, to defraud Janney by having it pay sham finder fees to LUMAC Corp., a shell company owned by the Maclis. Thomas Macli was a mailman, and Donna Macli was a dental receptionist.

Gary Manfre, a trader at Nomura, schemed with his brother, Richard Manfre, Simone and Joseph Lando to defraud Nomura through sham finder fees paid to RAM Solutions, Inc., a shell company owned by Richard Manfre, a perfume salesman. Simone and Lando had VDM and Janney pay sham fees to RAM after Gary Manfre had Nomura lend stock to VDM and Janney at low interest rates. Simone and Lando loaned the same stock to other firms at higher rates, and RAM's finder fees were paid out of these artificial profits.

Anthony Pianelli also schemed with Joseph Lando to defraud Weiss Peck and Janney by paying sham finder fees to ### ### Enterprises, LLC (JJE), a purported finder owned by Jill Pianelli, Anthony Pianelli's wife. Lando had Janney pay fees to JJE on loan transactions with Weiss Peck that were arranged entirely by Anthony Pianelli and Lando.
Relief Sought and Obtained by the SEC and Other Authorities
The Commission's complaints seek permanent antifraud injunctions, disgorgement of illegal profits with prejudgment interest, and civil monetary penalties.

The United States Attorney's Office for the Eastern District of New York has filed parallel criminal charges against 16 of the individuals named in the Commission's complaints. Ten of those individuals have entered guilty pleas: Simone, Caracciolo, Sorrentino, Carannante, Daronzio, Roman, Sarnicola, McCormack, Gary Manfre and Miller. In connection with his guilty plea, Simone also agreed to pay a total of $3.6 million in forfeiture.

Simone, Island, Gary Manfre, Richard Manfre and RAM have agreed to settle the SEC charges by consenting, without admitting or denying the allegations of the complaint, to the entry of permanent antifraud injunctions. Gary Manfre, Richard Manfre and RAM also will jointly disgorge $94,262, the total amount of their ill-gotten gains plus prejudgment interest. Because Simone has agreed to forfeit an amount equivalent to his ill-gotten gains in conjunction with his guilty plea in the parallel criminal case, the consent judgment in the SEC case does not require disgorgement of those same ill-gotten gains. The Commission's claims for civil penalties against Simone, Island and Gary Manfre, and all of its claims against the other defendants in both cases, remain pending. In addition, the Commission today issued administrative orders respectively barring Simone, Gary Manfre and Caracciolo from association with any broker-dealer. The three respondents consented to the issuance of the respective orders.

The subcontracted through little postal stores. It's how these little companies are able to cut costs by sharing expenses. I don't know why people would call these little stores up and ask them about USXP. I'm sure they have no clue as to how the little stores operate. They subcontact with people like RA, flower companies, mail for businesses and other related goods and services. RA made it so all you had to do was take your luggage to one of the little postal stores and drop it off instead of having to go clear to the airport. This would save gas and it probably cut the cost down to have the luggage shipped ahead. They have these little stores all over.

I know I could be wrong. So could you. We don't know what is going on. Regardless of everything we say there is one thing to remember. It's a penny stock. It's a VERY RISKY BET. That's what makes it so much fun. And you can't hardly lose much more than a good weekend worth of entertainment would cost. �

Kursmanipulation und Gegenmaßnahmen, ...angenommen, du kaufst 1000 Aktien eines Stocks. der manipulative MM, der diesen Trade für dich ausführt, kann diese 1000 Aktien sofort leihen und bereits einen Trade später gegen dich einsetzen, indem er diese 1000 Aktien ins bid verkauft, also billiger. da die Umsätze erst nach 3 tagen gecovert werden müssen (also abgerechnet), kann der MM mit dem gesamten (kauf)Volumen ins bid gehen und somit eigentlich kaufwillige abhalten, weil die sich natürlich fragen " wer verkauft denn da zu diesen Schweinepreisen?" , was dazu führen kann, dass trotz guter News ein stock nicht steigt oder sogar fällt.

Wenn das von mehreren MM betrieben wird, ergibt sich im Handel ein verzerrtes bild der Realität. eigentlich ist der stock bereit zu steigen, wird aber dadurch das die Shares der Ask Käufer sofort wieder billiger ins Ask gegeben werden, im lauf ausgebremst und fällt sogar. dieses spiel kann diverse tage so gehen und die Anleger richtig Geld kaufen. viele verkaufen am gleichen tag oder spätestens nach 2-3 tagen entnervt ihre " fallenden" Aktien, was dazu führt, das der preis noch weiter fällt. Netter Nebeneffekt für die Shorts: bei fallenden Kursen sammeln sie links und rechts noch Stop Losses ein und die abends nach hause kommenden Shareholder fragen sich, wo ihre Aktien geblieben sind. flankiert wird dieses vorgehen oft von Bashern, die zuhauf in den Boards auftauchen und dort die Verunsicherung weiter schüren.

Nun wurde zum Jahreswechsel ja die SHO Regelung eingeführt, die die MM und Shorties zwingen sollte, nach 3 tagen zu covern, also geliehene Shares glattzustellen. was dann bedeutet hätte, das bei fundamental guten werten und standfesten Shareholdern die Shorties und MM reichlich Aktien hätten kaufen müssen, um die geliehenen wieder glattzustellen. das hätte zu extrem steigenden Kursen führen können (ein sogenannter Short Squeeze), weil bei theoretisch über 3 Tagen geliehenen und short verkauften 10 Millionen Aktien auch die gleiche menge Aktien hätte gekauft werden müssen -und das in der Regel aus dem Ask, was eben für einen fetten Rebound gesorgt hätte.

Da die MM und Hedges aber nicht doof sind, passiert nach dem drei tagen folgendes: der MM, der mit z. b. 50.000 Aktien short ist und nach Ablauf der 3 tage eigentlich covern müsste, leiht sich diese 50.000 Aktien von einem anderen MM, der nun wiederum 3 tage zeit hat, der verliehenen 50.000 Aktien zu covern. was dann passiert? richtig, MM Nummer 2 findet MM Nummer 3, der ihm erneut 50.000 " leiht" . dieses spiel kann unendlich fortgeführt werden, es könnte sogar der erste MM wieder 50.000 Aktien der Nummer 3 leihen, weil ja MM Nummer 1 durch MM Nummer zwei gecovert wurde.

und so kommt es, dass es reichlich werte auf der SHO liste gibt, die dort seit Wochen (was ja eigentlich unmöglich ist)stehen und aus diesem miesen Kreislauf nicht herauskommen und weiter fallen oder stagnieren.

ganz pervers wird es beim nächsten punkt:beim naked shorten wird oft auf Margin Basis gehandelt, das bedeutet, dass wenn du z.b. 1000 Aktien gekauft hast, diese zwischen 4- und 10-fach beliehen werden. mit jedem kauf von 1000 Aktien löst du also mögliche Verkäufe von 4000-10.000 Aktien aus. auch hier wird das covern - wie oben besprochen- durch gegenseitiges beleihen ausgebremst.

das meinte RA doch mit dem ex-clearing und deshalb war ja die Abschaffung des GF clause nur ein erster Schritt auf dem Weg, den Schweinen das Handwerk zu legen.

Deshalb ist ja die einzige Möglichkeit bisher, sämtliche outstanding shares aufzukaufen, was bei OSTK gemacht wurde und hoffentlich bei USXP gerade passiert.

Nach meiner persönlichen Einschätzung ist unredlich erworbenes Geld viel schneller weg als hart verdientes. Ich denke, es ist im wesentlichen weg für teure Autos, Uhren, Designer -Kram , Yachten, Reisen, Mädchen und Partys, sowas soll angeblich das schlechte Gewissen betäuben. Es berauscht. Für kurze Zeit, dann braucht es Nachschub.

Wenn so was auffliegt, dürfte max. 10 % noch irgendwie und irgendwo vorhanden sein.

Alles nur unmaßgebliche persönliche Meinung.

Erst durch die jahrelange Aufklärung von immer mehr Aktionären wird die Manipulation nach und nach bekannt.

So mußte die SEC inzwischen nicht nur zugeben, daß es NSS gibt, sondern es rollen auch gehörig Köpfe bei denen und es laufen in letzter Zeit ständig Prozesse wegen der Manipulationen.

Diese Erklärung (oben); endlich ´mal in deutsch, ist äußerst wichtig und wer das als spam bezeichnet, ist selbst spam !!!!

09/27/07 "ICH " -- - It is evident that the US or Israel is going to launch an unprovoked attack on Iran in the near future, just as it did against Iraq and countless other defenseless nations within recent memory. As a result, untold numbers of innocent people will die and huge sums of money will change hands. Both the U.S. and Israel will consolidate their power in the Middle East and injustice and death will follow in their wake.

Bush’s co-conspirators in Congress are standing down, leaving little doubt as to whom they serve. As always, the mainstream media is preparing the way by serving as an organ of the Military-industrial complex by beating the drums of war and perpetuating lies.

Outside of a small number of citizens, few people seem capable of plumbing the depths of our conundrum. Under the umbrella of capitalism, business is the business of America, and death, inequity, and misery are its chief byproducts. Thus the rich are getting richer and the wealth generated by the producers is being concentrated into fewer hands than ever before.

War and class warfare are among the offshoots of capitalism. They are opposite sides of the same coin, like Democrat and Republican. Significant change will not occur until the people rise up in revolt and take matters into their own hands—a state of affairs that is virtually unimaginable. Nothing less than a fundamental paradigm shift from capitalism to a just an equitable socio-economic system is required.

It is not difficult to know what kind of response the present threat demands of us—yet only a handful of thoughtful and courageous people will act appropriately against them.

I am quite certain that indifference, apathy, belligerent nationalism, and dumb-foundedness are not appropriate responses to the cancer that is festering in the Pentagon, the halls of Congress, and America’s corporate board rooms and political think tanks.

I am willing to bet that the average American never contemplates the inequities that capitalism foists upon the world, or the unwarranted faith we have in the concept of private ownership, unregulated markets, and trickle down economics. This is a system that was created to serve the wealthy and to oppress the majority, and it is fundamentally predatory in nature.

Championed by the likes of Milton Friedman, capitalism and private ownership is the holy grail of the American economic system, and they are considered beyond reproach even by those who barely survive under their ponderous weight. The nemesis of capital and privilege is an organized and mobilized citizenry. Throughout America’s short history, alternative political and economic systems such as communism and socialism, long associated with organized labor and radical unionism, have occasionally gained a foothold in the barren political landscape and, predictably, were thoroughly demonized by the mainstream media and its corporate funders.

Alternatives to capitalism have been tried but they have always been undermined by the US, which allows their critics to assert that these social experiments have been tried and failed. But left alone to evolve without outside interference, other socio-economic systems that serve people and the public interest might well flourish over for profit systems that promote private enterprise, which explains why so much energy and treasure is spent to undermine them.

Does anyone really believe that capitalism would be so prevalent today if it had been so systematically undermined by other governments as its counterparts? The playing field has never been level. Yet, despite such intense oppression, alternatives continue to spring up like undesirable weeds in capitalism’s well groomed garden. Left untended, the garden quickly reverts to its natural state, which, clearly, is not capitalism or public funded privatized wealth accumulation.

Early on, working class Americans have been programmed to rail against any system that poses a threat to capitalism and its attendant Plutocratic rule. There was the era of McCarthyism in the 1950’s, and long before that the constant specter of the red menace that has always been associated with organized labor and other social justice movements.

Any ideology that is opposed to capitalism has always been presented to the people as a threat to democracy itself, which is an absurd notion. Through propaganda and other distortions of truth, the interests of the ruling clique are widely perceived to also be the people’s interest. Nothing could be farther from the truth. Democracy is the greatest threat to capitalism and Plutocracy; and, as history attests, it is vigorously repressed by those in power, often by acts of state sponsored terrorism and militarism.

Unregulated corporate power and the unbridled exploitation of land and people are as far from true free markets and democracy as anything can be.

Through the judicious use of lies and propaganda the corporate media, aided by the educational system, has successfully steered the collective American psyche away from the very ideologies that might potentially be our greatest benefactors. The underlying causes of societal injustice, including the inequitable distribution of wealth and power, are thus kept safely out of the public conscience, beyond the pale of moral and intellectual discourse. Unregulated corporate power and free markets are hailed in the mainstream media as humankind’s greatest achievements. They are marketed to the very people it exploits as liberating, democratic institutions.

The founding fathers recognized that an aroused and organized citizenry was the primary threat to the ruling elite. Organized labor, in particular, has always been perceived as a threat to the established orthodoxy. A democratic workplace would inevitably lead to a democratic society, and thus deny the strength of the ruling Plutocracy.

It is remarkable that for more than 230 years the Plutocracy has not only successfully kept the majority of the people supporting economic and social policy that is detrimental to the people, they have also kept them from thinking about alternatives that could provide relief from the social and economic injustice wrought by capitalism—among them, universal health care and socialized higher education. The government is always waging a cold war against the working class people, whatever their country of origin.

As a result, we have evolved into a nation of imperialists addicted to war and other forms of violence, which accrues tremendous wealth and power to the rich, while simultaneously undermining the people’s collective welfare, and the wellbeing of the planet.

Attached to their ipods, cell phones, their computers, television sets, and right wing media, the American people are detached from reality. So long as they are free to consume and waste, and sufficient entertainment is provided, the people will not rise up in revolt.

Because of this separation from reality, Americans do not empathize with people outside of their own immediate families, beyond a small sphere of friends and acquaintances. We have no sense of community, and little visceral connection to the wild earth that sustains all life. We are reductionists who do not appreciate the organic whole. Thus we cannot connect the dots and think in rational terms of cause and effect. We have commodified the earth and her people in order to exploit them for profit.

Too many Americans exist with a false sense of entitlement and privilege that is not nearly as prevalent in other parts of the world, where the effects of capitalism are better understood. Confident in our right to consume, while ignoring the misery our consumption and waste is causing others, we do not perceive the connection between capitalism, war, socio-economic class, cheap labor, and planetary destruction.

Dr. Martin Luther King said: “Injustice anywhere is a threat to justice everywhere.” The Wobblies understood: “An injury to one is an injury to all.” But we do not easily think beyond the self and rarely see ourselves as a part of a vibrant global community—a part of nature. We even erect psychological barriers that prevent us from questioning the established orthodoxy, as we witnessed in the aftermath of 9-11. We do as we are told, rather than doing what is right and just. Americans fear the government and tremble before authority.

It is this spiritual isolation and emptiness that allows us to comprise so little of the earth’s population, and to consume so much of her precious biological and ecological wealth—the planetary life support systems that sustain all life.

The American worker, despite all evidence to the contrary, and notwithstanding the lessons of history, continues to subscribe to the ideology of the capitalist model and its empty promises dressed in the seductive garments of the ‘American Dream’. That dream is now, more than ever, as millions of Americans are coming to realize, more myth than reality.

Capitalism has forced a nation-sized plantation upon the working class people of this country, and a world-sized gulag upon people everywhere. Workers keep only a tiny percent of the wealth they create for their employers, just enough to keep them playing the game—a game only a select few will ever win. Someone else always reaps the benefits of our labor.

American workers are like hamsters imprisoned in a cage, spinning our hamster wheels with furious speed, working harder, producing more, more, more—ever more; until our hearts explode or our bodies wear out under mountains of debt.

Hardly a handful of people realize what an elaborate hoax has been erected around us, what a sham this moribund system of waste and exploitation really is.

So we go from one plantation to another, drifting like tumbleweeds from one job to another but always imprisoned by the same exploitive, dehumanizing capitalist system.

At some level, I believe that the majority of the people intuit that something is terribly wrong. Thus they subscribe to the idea of reform and resort to electoral politics—a system that is wholly owned and operated by special interest money and corporate lobbyists. Their faith in the vote is misplaced and their energy is misdirected, which thus helps to maintain the established order, and prevents us from doing anything meaningful and direct. It assures consistency through the centuries: Imperial wars and occupations, a widening gap between the rich and poor; falling wages, union busting, and unfathomable environmental destruction on a global scale.

There are no political solutions available to us. There are no knights in shinning armor coming to the rescue. In a system awash in money the vote has no meaning. It is a mistake to think that the tools provided by capitalism can do anything other than perpetuate the system that is already in place, as history clearly demonstrates. Whether George Bush, Ron Paul, or Hillary Clinton occupies the White House, the result will be the same. Politicians are the property of special interest money. Few of them serve the people.

We must stop believing that reform of this corrupt system is even possible. Misplaced faith in corrupt politicians keeps us from fomenting the seeds of revolution, which are our only salvation and our destiny if we are to survive as a people. If only we could conjure up the fighting spirit that these times require.

People can only affect change by accepting personal responsibility and through direct action. We, ourselves, must become the agents for radical, revolutionary transformation. Rather than putting our trust in George Bush and Hillary Clinton or the sycophants in Congress, we must believe in ourselves and directly assert the power we have. We the people, when organized and mobilized, are the most powerful revolutionary force on earth. All we need is solidarity, but solidarity can be as elusive as a wisp of smoke, especially when so much capital is expended to keep us isolated and disorganized, and propagandized.

Both voting and sporadic protests, while they may temporarily make us feel useful, do not have much long term effect. Let us not simply say no to war with our vote, but with our bodies and our treasure. If we wish to see social justice enacted, we must not merely vote for it, we must, ourselves, become the agents of justice. We must oppose injustice not only on philosophical and ethical grounds, but in the theater of action, with our bodies.

Democracy and justice are too important to entrust to politicians who serve money, rather than people and the public welfare. We must do more than give lip service to the mere symbols of justice while doing nothing to actually obtain justice, or even worse—undermining it by voting more Plutocrats into office. Each of us must act to bring justice to bear. It is wrong to quietly tolerate what is being done to our country.

Our collective tolerance for injustice and mediocrity makes us complicit in them. We do not hold the criminals and the real terrorists accountable and we continue to support the system that ushered them into power by participating in it and pretending that it is legitimate.

Action applied directly at the point of injustice is the only force that can bring about permanent and just change. But action, unlike rhetoric, requires courage and conviction. It means putting the fear of god into the hearts of the government, as ordinary people do in Europe and Latin America, putting our bodies on the line for what we believe in. When the state is an enemy of the people, all just men and women must become enemies of the state.

Change begins and ends with the individual. What we think and what we do matters only if we act on our beliefs and are even willing to die for them, if necessary. Peace can only follow justice; it never precedes it.

By putting faith in those who serve the almighty dollar, rather than directly upholding the principles of democracy ourselves, we diminish our own power—we cede it to the corrupt and diabolical whose primary purpose is to rape and exploit us. Let us leave the safe haven of our hamster wheels and occupy the streets until justice reigns for everyone. There is no other way.

Ich tippe, daß wir hoffentlich bald alle klüger sind !
Ganz egal, wie die Geschichte ausgeht und wer recht hatte; schämen muß sich Niemand dafür, ein Mensch zu sein, der sich irren kann.

Schämen müssen sich nur Diejenigen, die meinen, alles zu wissen.

Ich für meinen Teil sehe täglich an den anderen Aktien, daß die Charttechnik funktioniert. Wenn das bei USXP als OTC-Wert nicht so sein sollte, habe ich wieder etwas gelernt.
Solange die Aktie aber noch gehandelt wird und die Signale nach oben zeigen, ist für mich alles offen.

Wenn die absolut positiven Signale des Charts nicht wären, würde ich die Meinung von Cyba, Alysant etc. ja teilen. Die Tatsachen sprechen gegen einen USXP-Hype. Nur würde ich mich im Unterschied zu diesen Herren nicht über anders Denkende lustig machen.

Ich habe aber an der Börse schon so manche Überraschung erlebt wie z.B. den Hype bei der insolventen Adori durch eine spam-mail und anderes.

Deshalb, wegen der Charttechnik und wegen des 15.10. und des noch offenen Ausgangs der 700 Mio.-Geschichte, der MJ-songs und des ominösen Käufers, vor allem nach dem receivership, hoffe ich weiter.

Es ist doch so: wenn Jemand einen Anderen mit dem Auto überfährt, dann ist das eine Straftat.
Wenn der Überfahrene schon krank war oder ein Lügner, spielt das keine Rolle. Es bleibt trotzdem eine Straftat !

Nun besagt die Aufhebung des GF clause, daß a l l e NSS-Positionen gecovert werden müssen; auch die vor 2005, die bisher offen bleiben konnten. Daß damals USXP massiv naked geshortet wurde, ist aber vor Gericht bewiesen worden !

Da dürfte es doch keine Rolle spielen, ob RA in den letzten Jahren Mist gebaut, gelogen hat etc.

Hauptsache ist, daß USXP nicht vor dem 15.10. dicht gemacht wird und die shorties nicht andere Schlupflöcher nutzen, um nicht covern zu müssen (z.B. ex-clearing).

Wenn USXP überlebt, werden wir evtl. einen Hype sehen wie bei OSTK und CYBL und die haben ja erst angefangen zu steigen !

There is no question that USXP was a victim of naked
shorting ...both before and after our lawsuit against the SEC .

we proved it before .. can we prove it after ?

AFTER, would mean the SEC is liable ..simple .if only we can bring

bought billions of shares .. we still dont know for certain if

so big the higher the price goes and maintains that level , it gives
the longs a chance to make money at the brokers expense .after the
spike ..the shorting continued .

In 2006 the "diluted" spike sent us to 4 cents .. it should have
been 1 dollar ..Wall Street injected billions of shares during the
month of febuary to limit the damage . These phony shares are a
perfect weapon against a sudden short squeeze .. i must say the mm's
are good .There only problem is ...when a counterfeit share is sold
it creates a naked short position ,but since the owner of these
shares hasnt come forward to claim anything or even order certs
WallStreet comes away looking honest and RA the crook . On the
surface it looks lke just another 100 bagger pump and dump.

looking back now in 2006 we had a chane to walk away with a handsome
profit , but the pps should have went much higher if wall street
didnt sell so many shares . .most of us were gone if it hit 1 buck
last year ..and it should of , if only the 6 billion shares were
sold were real ones ..that would inculde ours ..because we were
gonzo ..in brazil.

RA made several key mistakes ..one was having confidence in the
judicial system ..that was the most important of all .
faith in the arabs would be a close second .

his best move was having Bud on retainer ,yet he didnt use Buds
opinions .



He had a chance to exit U.S markets ...Bud claimed this would be a
sure footed way to help shareholders , he even mentioned it hiting
a dollar ....
"To the contrary, the excess shares owned offshore could force
delivery settlement by buy-ins.



Chris and Richard are sharp, and I have presented them with this

he did let us down . the imminent closings never materialized ..we
waited anxiously for nothing . ill bet if he knew the receiver was
coming he would have chose a different path .

it was like a tag team wrestling match "RA and the arabs" against
the "SEC and naked shorters"
the arabs showed up to the ring , but never got in , even as RA was
begging to be tagged in . .and meanwhile all the
spectators/shareholders bet for team "RA/ARAB" and lost their
shirts

i wonder if RA presented this (move to another excahnge)
to he arabs .. and i wonder if they denied it .

Für mich ist die Analyse der Person RA interessant:

Keine Ahnung, ob er neben seinem Studium arbeiten mußte oder ob seine italienische Familie das Studium bezahlen konnte. Auf jeden Fall hat er an 2 guten Unis studiert. Danach die Marine. Dafür muß man schon ziemlich ehrgeizig sein, denn die Ausbildung ist ja kein Zuckerschlecken. Könnte mir vorstellen, daß er das gemacht hat, um später eine große Karriere zu machen.
Dann Investmentbanker mit wahrscheinlich gutem Gehalt und dann USXP und die Idee, eine Weltfirma aufzubauen.
Genau da haben die NSSler seinen Traum kaputt gemacht. Nun wurde er zu einem angeschossenen Tier und wollte den Kampf mit Goliath aufnehmen. Mit der Zeit fing er an, selbst mit unlauteren Mitteln zu arbeiten, falsche PR´s zu verbreiten etc.
Nach den ersten 4 Jahren mit Gehaltsverzicht hat er danach umso kräftiger zugeschlagen.

Das soll keine Verteidigung von RA sein. Jeder Verbrecher soll seine gerechte Strafe bekommen. Es ist aber immer interessant, wie es dazu kam; das gilt auch für alle anderen Kriminellen.

Ich habe mir ´mal die Seite der einen Uni angesehen, an der RA studiert hat. Da gibt es eine Seite, die zeigt, was so alles aus einigen Absolventen geworden ist. Dort habe ich auch den Bürgermeister von New York gefunden.
Was mag im Kopf von RA vorgegangen sein, wenn er all die Karrieren seiner Mitstreiter von Uni und Marines beobachtet hat ?

Wahrscheinlich ist er einfach größenwahnsinnig geworden und statt sich darauf zu konzentrieren, die Umsätze von USXP in kleinen Schritten zu steigern und die Zahlen in den Filings zu verbessern, ist er von der TV-Station zum Autorennen, und vom Sportstadion zu unzähligen Prozessen und Anwälten gerannt.

Die Sache mit den Saudis scheint ja nun auch zu stimmen, so wie das mit den Marines, der Auktion und Herrn Bello.
Aber die Saudis wollten eben erst mehr Geld locker machen, wenn die Probleme mit der SEC bereinigt sind und das ist verständlich.

Einige Rätsel gibt es noch zu lösen. RA soll im Dezember 2006 angeblich eine andere Corp. gegründet und zu seinen Ex-Mitarbeitern gesagt haben, daß er USXP kaufen will. Vielleicht ist er ja selbst der ominöse Käufer der letzten Zeit ?

Es ist schon schade, daß die USXP-story nun zu Ende zu sein scheint. Aber es ist auch klar, daß man bei jeder Aktie, besonders bei OTC-Werten, 100 % verlieren kann.
Hauptsache man lernt etwas daraus...

und mit einer anderen "Firma" dann die Geschäfte anzuleiern.

Nur wir würden voll in die Röhre glotzen !
wer würde mit RA noch irgendeine Vereinbarung treffen ? na zumindest kein Seriöser ! dass ist klar.

wenn man einmal in die graue Zohne abgetaucht ist wie RA, dann zieht man auch nur noch zwielichtige Gestalten an, siehe die MJ Auktion ! war genau so ein Ding !

Nun brauchen sich die NSS´ler nur noch einen Winkelzug bis zum 15.10.07 auszudenken und dass war´s dann mit der Herrlichkeit von usxp !!!! So wie es aussieht bekommen die NSS´ler dann auch noch von der SEC Rückendeckung. Denn dann sind alle fein raus.

Und RA findet dann garantiert eine neue usxp-Familie im Knast !
die Burschen werden sich dann sehr führsorglich (vor allem Nacht´s) um ihn kümmern.

Naja, um eine USXP-Party zu feiern, müßte schon noch das Wunder von Boca Raton passieren.





Man muß ja realistisch bleiben.
Für mich ist es nicht schlimm, wenn ich 3/4 des USXP-Gewinns vom vorigen Jahr wieder veliere. Außerdem laufen meine anderen Aktien gut.
Für die anderen, die echte Verluste mit USXP erleiden, tut es mir leid. Wer jedoch ausschließlich USXP-Aktien hat, dem sollte das eine Lehre sein, in Zukunft nicht alles auf ein Pferd zu setzen; schon gar nicht auf so eine Risiko-Aktie.

Da möchte ich teilweise widersprechen. In Deutschland sind Immobilien in einer ganzen Reihe von Gebieten am Beginn einer Aufschwungsphase. Das gilt insbesondere für Wohnimmobilien, vor allem in den Ballungsräumen Rhein-Main, Großräume Stuttgart, Hamburg , München und sogar in Teilen von Berlin. In Berlin ist ein bemerkenswerter Aufschwung bei Gewerbeimmobilien zu vermerken.
Die sog. Immobilienuhr ist bei den vorgenannten Immobilien bei 6 bis 7:30 Uhr, das heißt Talsohle überwunden.

Aber Heuschrecken haben inzwischen teilweise vorhandene Fehlkalkulationen bemerkt. Nichts dagegen. Solide Käufer können aber gute Geschäfte machen.

Das stimmt. D und Berlin bilden im Moment noch die einzige Ausnahme in Europa. Aber wie lange ?
Was ist, wenn in einigen Jahren die Leute in Rente gehen, die jahrelang von Hartz 4 gelebt haben ? Wenn jetzt ein Durchschnittsrentner 1400 Euro hat, was hat einer in 10 Jahren ?

Ein einheitliches europäisches Preis-Niveau gibt es nicht, es sind immer noch Landes-Märkte mit einem großen Spread, aber auch unterschiedlicher Bauqualität, unterschiedlichem verfügbaren Einkommen. Und schon in Meck-Pom ist die Welt völlig anders als im Hamburger Umland. Den Europäischen Markt gibt es nicht behaupte ich. Daher hat sich ja die Immobilien-Uhr so bewährt, die für die unterschiedlichen Metropolen jeweils einen eigenen Takt wiedergibt.

Ja was machen Hartz 4-Empfänger? Heute wohnen die meisten von ihnen in Sozialwohnungen, die Allgemeinheit zahlt. Wenn diese Personen nun in Rente gehen, werden sie vermutlich weiterhin in Sozialwohnungen wohnen.

Die Schere wird aber eindeutig größer. Nichts verkauft sich so gut wie Penthaus-Wohnungen, das fängt oft erst bei 850 T€ an. Bei der Miete manifestieren sich Schwellenwerte bei 1200 €, 1500 € und 1995 €, also unter 2000 € Miete netto kalt für DINKs ( double income no kids) für eine Wohnung von 120-140 qm. Familien mit 2 Kindern verfügen oft nur gerade über eine 80 qm 3-Zi-Wohnung.

Universal Express: Lies and More Lies

The gravy train appears to be over for Richard Altomare, the man who ran a company called Universal Express and paid himself very well out of cash from shares that were illegally sold to the public.

If you’re new to this lovely company, you can read a column I wrote on the suit filed against it by the Securities and Exchange Commission. For a dissenting view, you can look at full page ad it ran in The Times. Basically, Mr. Altomare claims that there is a massive conspiracy against his company because he dared to expose naked short-selling.

A federal judge appointed a receiver, Jane W. Moscowitz, and she has now reported that “none of its operations are profitable” and that the company did not have enough money to make its payroll. She says Mr. Altomare told workers she was lying.

She is selling assets, but some of them have proved hard to find. Mr. Altomare reported that Universal Express had $300,000 to $600,000 in escrow with a company that occupies some of Universal’s office space in Boca Raton, Fla. That company denied it. Universal’s law firms claim they are owed money, rather than having been paid retainers that have not yet been earned, as the books showed.

The receiver reports that Mr. Altomare was paid a little more than $1 million this year, and that does not count $29,000 in checks to a Las Vegas casino, or wires totaling $80,000 to a Boca Raton jewelry store.

The company’s largest asset by far is more than $500 million the company says it is owed by naked short-sellers it sued, and won judgments against in 2001 and 2003. “We believe the judgments are substantially collectable,”
the company has told shareholders. But Ms. Moscowitz reports that the company’s lawyer has only collected an amount that “almost covered” his expenses, and that no money came to the company.

Universal’s shares still trade over-the counter, at about 33 for a penny. The receiver reports:

“A number of shareholders have sent me e-mails asking about the status of their investment in shares of the company. The e-mails are often emotional and occasionally threatening, accusing me of destroying their investment. These correspondents seem to have no idea of the company’s terrible financial condition.”

She includes some of the more colorful e-mails. Here’s an excerpt from one, edited to remove obscenities but not to correct spelling:

“If you think for one second you can come barge into a company that is only trying to stay alive because of the rampped knaked short selling and shut it down, think again. If you try to hide the truth behind this huge short position and how corrupt the SEC really is you are going to be hit with a … load of lawsuits, and if justice doesn’t prevail the good old American way, then I will make it my personal duty to enforce the justice and I along with others will come and beat your … to a bloody pulp . . . “

The trustee has directed Universal’s lawyers to drop its appeal of the order that resulted in the trustee’s appointment, a fact that no doubt will add to conspiracy theories. But that won’t stop Mr. Altomare and the company’s former general counsel from appealing the rulings against them. Their next court date is Oct. 12, when the judge has ordered them to show cause why they should not be held in comtempt.

For the uninitiated, this stock is and has always been about the “alleged” huge naked short position in the company’s shares. A simple and effective way to put this myth or fact to rest is for the court-appointed Receiver to hire a “third party” to reconcile the “Stock Transfer Register”. In this way, an independent party, not the SEC or the company, can verify as to who owns what shares and is there or is there not a severe naked short position in this company. Is that too much to ask on behalf of thousands of stranded and hapless shreholders who were mainly attracted to this company by this incessant claim ? Have you ever stopped to ask why the SEC would not open its books and settle this once and for all or why Judge Lynch did not order this ?

es ist echt unglaublich ! Wenn ich die desaströsen Fakten von USXP nicht kennen und nur auf die Chartsignale achten würde, würde ich heute unbedingt USXP kaufen !!!

Guckt Euch doch USXP ´mal z.B. bei www.comdirect.de an !

Clickt auf candlesticks und wählt den Zeitraum unendlich ! Dann guck Euch den Slow Stochastik an ! (auf "erweitert" clicken und dann auswählen bei "Indikator unten")

Das ist absolut bullish und ich kapier einfach nicht, wieso !!!

dazu kommt noch, daß der Slow Stochastik seit Juli 07 sich ständig zwischen 50 und 100 % aufhält, was auch bullisch ist. Vorher ist er immer zwischen 0 und 50 % gependelt (außer beim Hype 2006).

Nach dem daily und weekly zeigt nun auch der monthly Stoch klar nach oben und der quarterly Stoch zeigt nicht mehr nach unten, sondern läuft waagerecht.

Das ist völlig mysteriös !

Du bist selber Humbug und ein Ignorant dazu !
Wenn ich die Technik nicht erst 2000 gelernt hätte, müßte ich schon jetzt nicht mehr arbeiten. Sie klappt 100 %ig bei normalen Werten.

Entweder funzt sie bei OTC-Werten nicht, oder USXP steigt noch mal kräftig !

mit extrem kleinen Wert gehandelt.
Mein online-Broker akzeptiert keinen Wert unter 0,00 nur bis 2 Stellen hinter dem Komma, somit kann ich keine Aktie kaufen die z.b. mit 0,0001 notiert ist.
Wer kann mir bitte sagen, wo das möglich ist.
