      Lynas can begin operations, rules court

      KUANTAN: Lynas Corp can finally fire up its long-completed rare earth refinery after the High Court here lifted the interim stay on its Temporary Operating Licence (TOL).

      Judge Justice Mariana Yahya said it was still premature to argue at this stage on the status of the TOL granted by the Atomic Energy Licensing Board (AELB) and it was only proper to do so during the judicial review cases challenging the Government’s decision to grant the licence.

      She dismissed with costs the Kuantan residents’ application for a stay on the TOL pending the judicial reviews.

      The court refused to put a temporary stay on the licence until the judicial reviews start at a date to be determined later.

      She had earlier allowed Lynas to amend its application to be an intervener with costs and also be a party in the upcoming judicial reviews.

      “The proposed intervener has satisfied the court that it is a proper party which has direct interests and is directly affected by the application for a stay on its TOL.

      “Therefore, there is no plausible reason to exclude Lynas from beco­ming a party,” she said in her judgment yesterday.

      Counsel for the residents Datuk Bastian Vendargon then stood up to file an oral application for an appeal against Justice Mariana’s decisions.

      Justice Mariana asked Vendargon to file a formal application so that all parties could be heard in court.

      She also dismissed the lawyer’s request for another interim injunction on the TOL until the application is filed and heard.

      Vendargon told reporters outside court that he would file the appeal application today.

      “We may appeal against more than one decision but the most important is the stay on the TOL,” he said.

      Meanwhile, Lynas Malaysia Sdn Bhd managing director Datuk Mashal Ahmad said the plant would begin operations as soon as possible.

      “This judgment reflects what we have been saying all along – that our plant is safe for the people and the environment,” he said.

      Hundreds of anti-Lynas protesters as well as the company’s employees had gathered at the court complex since 7.30am to await the decision.

      They engaged in a shouting match under the watchful eyes of the police.

      Kuantan OCPD ACP Mohd Jasmani Yusoff said no untoward incident happened and ordered the two groups to disperse immediately after the judgment was delivered.

      Malaysian Proceedings

      Lynas Corporation (ASX:LYC, OTC:LYSDY) refers to the Trading Halt request released to the market yesterday and advises that the Kuantan High Court has dismissed the application by the Save Malaysia Stop Lynas group for an interim stay in respect of the Temporary Operating Licence.

      Lynas has become aware that the applicants have appealed to the Malaysian Court of Appeal on the same issue. It is possible that the applicants may also make further applications on the same basis. However, we note that:

      • the judgment in the Kuantan High Court was very clear in its finding in favour of Lynas;
      • there remains no injunction or stay preventing Lynas from carrying out its operations at the LAMP; and
      • Lynas (or the Government of Malaysia) have, on several occasions in the past, successfully defended proceedings seeking injunctions, stay orders or similar orders including: the Kuantan High Court decisions in November 2012; a decision by the Malaysian Court of Appeal in September 2012; and a decision by the Kuala Lumpur High Court in April 2012;

      The recent legal proceedings in the Kuantan High Court have not detracted from the ongoing operational preparation of the LAMP for production. Lynas is committed to its objective of successfully transitioning to a rare earths producer and trusted supplier, with first feed to kiln expected by calendar year end, followed by a ramp-up period of 3-4 months until first commercial sale of REO product and subsequent cash generation..

      Institutional Placement and SPP

      Following the successful completion of the Institutional Placement and SPP, Lynas anticipates having required working capital through to positive cash flow, necessary funds to meet capital expenditure requirements and a significant cash buffer to allow for unforeseen events.

      Mount Kellett has approached Lynas to discuss whether the capital raising has triggered an adjustment mechanism under the Convertible Bond Deed Poll released to the market on 24 January 2012. As Lynas advised the market on 19 October 2012 the initial reset provisions of the Convertible Bond Deed Poll no longer apply in relation to the obligation to obtain a Temporary Operating Licence. As also advised on that date (and the date of issue of the Convertible Bonds) the terms do include 'customary anti-dilution' adjustment provisions. The Institutional Placement and SPP have not yet completed and therefore no determination can be reached on what adjustment, if any, may be made.

      Many of you are seeing too much red to actuallly read between the lines..

      There are alot of positives about Lynas over the past month:

      1. Lynas beyond doubt scientifically proven to be safe.
      2. Royal family backs international firms in Malaysia to grow economy and put rice bowls on tables, singles out Lynas.
      3. TOL stay appeal dismissed.
      4. Immediate CR which to me would suggest all systems go.
      5. Instos buying at premium to todays price @75c under 1st tranche of CR.
      6. MS closing out short positions.
      7. Todays notice Lynas are almost blazay about appeal which would suggest - dont stress its under control.
      8. SMSL resorting to tactics such as marching 300km, public support dwindling. Green peace is their last resort.. lol.
      9. RE pricing on the increase, Japan sourcing its RE outside of China.

      Looks to me if you bought in yesterday you will do quite okay.

      Second bid for Lynas suspension rejected

      A MALAYSIAN court yesterday dismissed another application by opponents seeking the suspension of Lynas Corporation's temporary licence to operate a rare-earths processing plant in Pahang state.

      Environmental group Save Malaysia Stop Lynas and others applied for a continued suspension pending an appeal of the Australian mining company's licence.

      A date for the appeal will be set at a hearing on November 30, Hon Kai Ping, a lawyer for Save Malaysia, said following the latest decision.

      The applicants are seeking an injunction halting the plant from processing material they claim is harmful to health.

      The Kuantan High Court on November 8 rejected Save Malaysia's application and lifted an order preventing the factory from operating under the temporary licence.

      That order included the importation of material extracted from Lynas's Mount Weld rare-earths deposit in Western Australia.

      The Pahang plant is expected to process about 20 per cent of the annual worldwide production of rare-earths minerals.

      A partial shutdown of production by rare earth producers in North and South China has led to a 20 percent rise in prices.

      The price of Neodymium-praseodymium oxide, a key rare earth mineral, now costs between 340,000 ($54,604) and 360,000 yuan a ton. Many of praseodymium's industrial uses involve filtering yellow from light sources. Dysprosium oxide is 2.8 to 3 million yuan a ton, according to the latest price on Baiinfo, a domestic financial information provider.

      Dysprosium is used for its high thermal neutron absorption in making control rods in nuclear reactors and for its high magnetic susceptibility in data storage applications.

      The prices are 10 to 20 percent higher than in October this year.

      There are no signs of price rises for lanthanocerite products, which has massive overcapacity.

      The partial shutdown in production is by rare earth producers such as China Minerals Rare Earth Co, Aluminum Corporation of China, Inner Mongolia Baotou Steel Rare-Earth (Group) Hi-Tech Co Ltd and some companies in East China's Jiangsu province

      Analysts say it is not clear whether the price increase will remain once full production resumes.

      Es ist schon erstaunlich was für Unsinn jetzt wieder über Lynas und rund um unser Thema gepostet wird.

      Einerseitz soll jetz schon laut einigen Usern ein Überangebot an "Seltenen Erden" auf dem Weltmarkt sein und andernseits brauchen immer mehr Hightechprodukte, gerade auch im Umwelt- und Energiebereich und u.a. auch zur sich Sicherung der Mobilitätder Medien usw., diese Rohstoffe, dazu steigt die Weltbevölkerung immer schneller und die westlichen Industriestaaten klagen über die WTO das China ihre Exprotbeschränkungen lockert.

      Dabei brauchte man IMHO nur den sogenannten gesunden Menschenverstand einschalten um zu merken wo der Hase hinläuft bzw. zwangsweise hinlaufen muss damit wir hier auf unserer Erden überhaupt noch eine Zukunft haben können.

      Glauben diese Leute eigendlich, das die institutiellen Anleger mal 150 Mill. ausschütten mit dem Wissen, dass sie gleichzeitig ihr Geld abschreiben können, oder wird anders herum ein Schuh daraus?

      Auch die MODs sind anscheinend mit dem Thema überfordert.
      Da wird behauptet, hier sei ein Märchenthread der von profisionellen Anlagebetrügern gefüttert wird und bashen Lynas mit falschen Zahlen und Angaben, was eindeutet gegen die Boardregeln verstößt und daher IMHO gelöscht und diese Poster verwarnt und im Wiederholungsfall gesperrt gehören und die MODS juckt das überhaupt nicht.

      Dabei ist für jeden, der sich nur ein wenig in der Materie auskennt ersichtlich, was diese Leute antreibt und dazu ist diese treiben und handeln alles andere als unbekannt bzw. Einzellfälle.

      Aber was solls, ich gehe jetzt auch dazu über diese Poster auf ignore zu setzen.

      I suggest that you underestimate the intelligence of MOST LYC holders.

      Personally all that this "shermozzle" has done for me is to have continually reduced my exit point. Lynas has for some time now fallen from grace as a GREAT company with GREAT potential to one whic is still undervalued. Where it should have caused the $4 party to be a past event and have us looking forward to the $10 party I suggest that the $2 party, while still feasable, is some time off. I will not qualify for that party when and if that day arrives.

      Persons that automatically TD any post that is not positive should review their thinking and be prepared to accept that Lynas is now not what it could have been.

      I blame the main problem as poor corporate governence but along with that is the fact that the ASX is no longer an investment facility but more a casino where the "house" sets the rules and allows funds to be skimmed by its associates in ever increasing percentages. Overpaid board members are also skimmers and at times are represented in "the house" along with merchant bankers. This leaves little left over for the superannuants with many retirees the losers. In this way many retirees who have counted on Lynas for income are being forced to take a loss in order to finance immediate financial requirements.

      Long gone are the days when bankers were "looked up to" in society. Greed, corporate greed, reigns supreme. Companies like Lynas assist with this "relocation' of money.

      Yes it is time to make the decision as to when it is time to move on.

      I don't understand why anyone is complaining about the capital raising. The previous announcement, released after the last CR in 2011, stated that they had enough funds to see them through to the start of production in September 2012 ... two months ago.

      The fact is they don't have enough money to get the ore from WA to Malaysia, process it and then export it. So what would shareholders have the company do? More debt?

      The CR is done, they're through the worst of the Malaysian regulatory and judicial delays and now they're within a few months of actually selling something for the first time in their long history.

      As a shareholder, if you don't feel optimistic about Lynas now, then when in their past did you feel more optimistic and why???
